1/ My thread on #GOP defense of #Trump: General defense amounts to 2 arguments: 1. #Trump was genuinely concerned about #corruption in #Ukraine; 2) not enough evidence to #impeach. We have no evidence on the first & evidence to the contrary. Legally, there’s enough evidence.
2/ The strongest args #GOP makes - #Trump not caught on tape saying he was abusing his office for his personal gain. Ukraine history of corruption & publicly denied pressure. But you have to suspend reason & ignore a boatload of evidence to conclude he did nothing impeachable.
3/ #GOP on 7/25 call -#Trump didn’t reference reelection, Ukrainians happy it happened. #Volker didn’t see problem, NSC not complaining. Discounts #LtColVindman. Ignores #Pence aide thought it was “unusual” & #LauraCooper said Ukraine asked abt aid status same day after the call
Thread: #Trump legal team arguments for creating the constitutional crisis of complete #obstruction turns on 3 arguments that are all merit less:
#TrumpOnstruction arg 1.: The House must vote to have #impeachmentknquiry. Nope. Constitution doesn’t require it & neither do House rules. Judiciary must vote articles out & then send to full House. They’re working on it.
#TrumpObstruction arg 2: His #dueprocess rights are being violated. Nope. You don’t have a right to all the evidence before your charges & preparing for trial. And #Whistleblower protection is necessary given enormous power of #POTUS. But Trump knows the allegations. We all do.
Of 235 #Dems in the House, 139 publicly support #impeachment investigation on #Ukraine allegations that #Trump personally & directly intervened in release of foreig#n aid $ to a “hot” war zone & raised investigating #Biden. Today I expect we will hear #Pelosi saying it’s time.
While the #MuellerReoort gave ample grounds for concern on #Trump campaign 271 contacts with #Russians, this is a case where #Trump admits undeniably dangerous behavior & obstructing Congressional oversight of it.
Congress & White House have a history of fighting abt what classified material Congress can have on demand. In this case, a fed’l law says that a #whistleblower complaint that the Inspector Gen’l finds “urgent” be sent to Congress Intel Committees. So what is “urgent”?
The federal law defines “urgent” as “A serious or flagrant problem, abuse, violation of law or Executive order,..., or operations of an intelligence activity involving #classified information...” among other things. This appears to be the relevant part of the #whistleblower story
Congress states “Congress as a co-equal branch of Gov’t, is empowered by the Constitution to serve as a check on the executive...it has a ‘need to know’ of allegations of wrongdoing...including allegations of wrongdoing in the Intelligence Community.” bit.ly/32RviOp
THREAD: I invoked Rod Serling & Twilight Zone when the news hit about #Trump asserting #ExcutivePrivilege over documents underlying #MuellerReport. I thought I should explain given your questions about US v Nixon & more.
First, there are two different issues to sort through. 1. grand jury material redacted in #MuellerReport and the grand jury material - documents - the report relies on; and 2. documents like McGahn's notes that Mueller refers to in the report that may exist outside of grand jury
House Dems are basically arguing they can see grand jury material behind closed doors (not public) without a court order. The Congressional Research Service notes that 2 court decisions agree with them & others do not. This sets up a court battle. fas.org/sgp/crs/secrec…

Thread: @arimelber asked me last night whether #TrumpShutDown was at all related to the pressure brought to bear by the #MuellerProbe. Let’s consider this more closely. It’s a distraction & attempt to show strength at a time that #Trump has been weakened.
First, #MuellerProbe will continue full steam ahead. It is funded and not impacted by #TrumpShutDown. The shutdown isn’t wise or good for anyone. So a shutdown only serves to help Trump if it makes him look strong and like a “winner” to his base. Wrong-headed But Trumpian logic.
Things to remember as we wake up to a partial #GovernmentShutdown: You will still get Medicare, Medicaid, SSI services. Dept of State, DOJ, DOT r among the agencies that will have to shut some activities. Homeland security won’t stop border enforcement, courts will operate.
THREAD: Robert Bowers is charged w hate crimes in #TreeofLifeSynogogue murders. It is the worst anti-Semitic #hate crime in US. It cant be tolerated. And It is far from the only hate-filled domestic terror attack-Emmanuel AME Church, Pulse Night Club. We need some facts.
These are acts of domestic terror. #Terrorism is a violent act that doesn’t target victims directly but intends to send a broader msg to the target population (Morin, 2016). In the case of hate it’s Jews, Black ppl, LGBTQ, Muslims.
Domestic terrorism is a terror is committed by someone or some group motivated by US Movements. And hate crimes like Tree of Life Synogogue shouting is domestic terrorism. Is it on the rise?
THREAD: My biggest takeaway from #BrettKavanaugh Fox News interview is that he wants a “fair process” but that process doesn’t include testimony from #MarkJudge or an #FBI background check on the allegations. THAT wld be fair.
No one, including the #kavanaugh family and of course the Ford family or anyone else coming forward on any side of those should be threatened or live in fear. That is plain wrong and unacceptable.
My second but no less central takeaway is his denial of binge drinking is not supported by some of his contemporaries.
