APPEAL COURT "STAY OF EXECUTION" AND THE PREMATURE EJACULATION OF RIVERS APC.

For clarity, Even if APC Rivers is on the ballot, PDP will beat them silly at the polls. But this is not the bane of discuss.

Today APC Rivers state got a "STAY OF EXECUTION " From the Appeal Court in respect of the Federal High Court declarative Judgement restraining INEC from recognising all APC candidates in the 2019 election.

First, getting a stay is normal in all civil matters. However, we need to know that a stay is not a judgement but a ruling. A stay can only be effective when the order or judgment has not been enforced. On this APC issue,

the Judgment has been enforced and APC delisted from the final list of Contestants by INEC.

secondly, the Stay is only against the Federal high Court judgement. There is still a State High Court and an Appeal Court judgement that declared the primaries of APC, it's candidates ,ward excos and State Excos as illegal, unlawful .

The APC is yet to vacate these Plethora of judgments against them but they are rejoicing on a stay that is temporary as against a permanent judgment .

For the avoidance of doubt, INEC did not and cannot claim to have based its decision solely on the Federal High Court judgement.
The State and Appeal Court Judgement was also considered in delisting APC from INEC list .

In conclusion, if you see any APC member jubilating , tap him or her and tell them to go get a stay and a judgment against the Appeal Court Judgment in the Supreme Court .
