I want EU citizens to know what happened in their name. The @EU_Commission acted as the long arm of multinational entertainment companies to block progressive #copyright reform in South Africa that would have helped millions of users & authors. A thread.
@EU_Commission On 18 February 2019, entertainment industry trade groups IFPI (music), MPA (Hollywood), FEP (publishers) etc sent a letter to the EU Commission, asking them to intervene in the ongoing South African copyright reform on their behalf.…
Their claim was that the reform would hurt creators, but actual creators were of a different view. Aside from introducing #fairuse, access to books for blind people and those who can't afford textbooks, the bill would also drastically improve the bargaining position of authors.

Read carefully.
The distinction between embedding a photograph or copying and pasting it comes into play, but for different reasons than Goldman v. Breitbart.

Goldman v. Breitbart isn't the decision to compare this to. Another one is.
The issue in Sinclair is whether, by uploading her photo to Instagram and agreeing to its terms of use, she granted a license to Instagram to sublicense it, and Instagram granted a sublicense for Mashable to embed a photograph.

The danger of false intellectual property infringement accusation - a thread:

The World Intellectual Property Organisation (WIPO) recently provided more detail on its “Building Respect for Intellectual Property” (BRIP) Database Project…
The BRIP database will list websites that “Authorized Contributors” from WIPO member states *allege* to be infringing #copyright and other IP rights.
The BRIP database will be able to be accessed by advertisers who are encouraged to stop having their ads served on the listed sites. The so called “follow-the-money” approach to bringing down infringing sites.

In “A New Copyright Bargain?”, @rgibli says that existing international #copyright laws are based on a number of assumptions that either no longer apply or have been disproven.

Is it time for a reexamination of the system we’ve developed?
One of those assumptions is that #copyright is a way to incentivize cultural production, but history and empirical evidence shows us the optimal copyright term to incentivize production is only 15-25 years.

Long copyright terms can actually discourage creativity.
It's also assumed that #copyright is necessary to encourage ongoing investment in existing works, but again empirical evidence shows the reverse: works in the public domain are more readily available.

Digitization is making it even easier for investment in public domain titles.

NEW: A federal appeals court just revived a #copyright case that accused a DC-area film festival of using a photo it found on the internet, overturning a ruling that said it was a "good faith" fair use of the image.

Here's the key quote:
The case was filed by a photographer against the organizers of the Northern Virginia International Film. He claimed they just plucked his image from a tumblr page and used it to promote the event.

Here's his image on the left and the festival page on the right.
The big thing about this case was the lower court's (sorta weird) decision that the photo was used "good faith." The trial judge factored that in when deciding that the film festival's use of the image was a legal fair use.

Software preservation is a really important part of digital preservation, and its value is only going to increase. Almost everything we make, now, is written in a language only computers running the right software can read. #prestc19 2/15
So without the right software, digital stuff (images, text, *everything*) is gibberish. Or (sometimes worse) it can be rendered, but only partially, imperfectly, not the way the author intended. Software is a tool, without which digital culture is lost. #prestc19 3/15

On the subject of taking photos from the internet and using it for your own website without a license: jury found website owner liable and awarded $150,000 statutory damages per photo infringement. That's $450,000 total.
The Ninth Circuit is kicking it back because of an erroneous instruction on "willful" infringement. Judge wrongly allowed a "should have known" standard. So, on remand, the most the statutory damages can be is $90,000, which is still a lot.
The "should have known" standard isn't good enough for willful infringement. The defendant website was only found liable for contributory copyright infringement, not direct infringement.
