The WH has released the text of the proclamation declaring a national emergency at the southern border and invoking military construction authority under 10 USC 2808. publicpool.kinja.com/subject-presid…
The presidential finding that construction of sections of bollard fencing *requires* the use of the armed forces, when construction of identical infrastructure hasn’t previously, is one likely pressure point in a statutory challenge to Trump’s action.
I still think, possibly too idealistically, that a constitutional challenge based on separation of powers ought to be the main event here.

This place was once called Palisades Del Rey, and it had developments full of fancy seaside homes. The arrival of the airport forced the people out--first through noise and air pollution (in an age before environmental laws), and later through eminent domain.
In the beachside community's early years, Cecil B. DeMille lived there. After LAX, it became first a bad investment, then a ghost town, and a target for vandals that had to be fenced off. Officials started removing roads/bldgs and restoring the sand dunes. southbay.goldenstate.is/paradise-lost-…
The last public access to the place ended with 9/11, when authorities closed the beach below the low-flying airplanes. Now rare blue butterflies (the first insect designated as endangered) and apparently burrowing owls live there.

One little thing I noticed from the latest ABJ transcript. The judge notes that a lot of Manafort’s lies have a nexus to Konstantin Kilimnik, rather than being random. In the process, she appears to disclose that the dispute about the $125,000 payment is related to Kilimnik too.

And the $125,000 payment matter also apparently relates to funds flowing to Manafort from “vendors associated with the campaign”

For one thing, it characterizes the Special Counsel's investigation and the warrants they have obtained--following the trail of the stolen emails point to point from hacking to dissemination. They might have taken other avenues to Stone's doorstep, e.g. Manafort's communications.
For another, it includes the first SCO confirmation of @NatashaBertrand's report that Stone communicated directly with Assange. It also firmly ties Stone to paragraph 44 of the Netyshko indictment, which quoted his DMs with Guccifer 2.0 but didn't name him.
But the main thing for me is a puzzle: The Stone indictment doesn't include any actual communications between Assange or Guccifer 2.0 and Stone or his intermediaries (other than Credico's public radio interview). It's all about what Stone, Corsi, and Credico said to each other...

5 US laws give POTUS consent for Military Eminent Domain during Wartime: Naval Appropriation Act of 1917, War Purposes Act, War Powers Act, National Defense Act of 1916, Act To authorize condemnation of lands for military purposes of 1917-1918. Not including 10 U.S. Code § 2663.
The Codified 10 U.S. Code § 2663 - Land acquisition authorities says: In time of war or when war is imminent, United States may, immediately upon filing of a petition for condemnation under paragraph (1), take and use the land to the extent of the interest sought to be acquired.

NT! As everyone knows by now, Trump will be signing (if he hasn't already) the "compromise" bill to fund the government until the next time funding comes up later this year, *and* will also be declaring a national emergency at our Southern border.
I'm of two minds about this. On one hand, I'm glad that the government won't again go into a partial shutdown, allowing for politicians to use that unjustifiably as a cudgel against Trump and the Republicans.
On the other hand, where's the compromise? This bill funds *55* miles of border barrier, or fencing, whatever you want to call it, which is far less than the *250* miles the *real* experts on the border said they actually needed.
