We have petitioned the PA Sec. of State for a re-examination of the ES&S ExpressVote XL based on our belief that it does not comply with the law in 10 important ways. inquirer.com/politics/elect…
1. The XL's ability to print on ballot cards after casting is not acceptable ballot security. It is common sense that no voting machine should have the ability to change votes. securiosa.com/posts/how_the_…
2. The XL stores ballot cards in chronological order, allowing election officials to discover how specific voters voted, violating their right to a secret ballot.🙈
3. In primaries, ballot cards (despite what you may have heard, the XL doesn't use a "paper ballot") must be on colored paper to clearly indicate the party, but the XL paper is white.
4. Ballot cards must have perforated numbered stubs which are detached by a poll worker immediately before submission to prevent ballot box stuffing and "chain voting"(nyvv.org/doc/TearOffBal…).
5. The XL prints votes as barcodes, not using any of the valid types of marks (X ✓ ⚫️) listed in the election code. The election code wants votes to be transparent to humans, not in marks only machines can read.
6. The XL does not let voters mark *on* the ballot card in clearly marked positions, as the election code requires.
7. Spoiling a ballot on the XL requires a poll worker to enter the voting booth. Only voters with a pre-registered disability can have anyone in the booth. Unlawful assistance in the booth is a misdemeanor with a fine and/or jail time for both the voter & poll worker. 👮🚔🏛
8. The XL's requirement that a poll worker enter the booth to help, either to spoil a ballot or so that a voter with disability can handle the ballot card, also violates ballot secrecy. They will look right at the votes as they retrieve the card! 👀
9. The XL got harsh reviews from the group of voters with disabilities who tested it. Every voter had at least one problem and no voter could verify their votes. HAVA requires that *all* voters be able to verify their votes (privately, independently).
10. The XL's "ballot cards" are not "paper ballots" as required by the Stein Settlement. These terms have clear, specific meanings in the election code.
We have asked for a quick re-examination because PA counties are currently making decisions. If the XL is not legal in PA, as we believe the above 10 deficiencies indicate, then counties need to know soon.
