Clearly there are serious issues that deserve consideration before any revision in #EIA2006Notification +

is taken up.
Yr 2020 is 14 yrs since 2006. #EIA2006 has been in operation all these years & good lessons & learnings must have been made as part of its implementation.
Thus a proper well analysed raison d’ etre for bringing in a new notification is in order on following +

lines:
a)Account taking of #EIA2006 in terms of what all was achieved in terms of total numbers of projects assessed, cleared, rejected etc
b)Whether #EIA2006 has helped ‘protect’ & ‘improve’ d environment which is d basic tenet of EPA1986
c)Whether #EIA2006 as a subordinate +

legislation has met d needs of national commitments made at Rio 1992
d)What on a hind sight appears to have been strengths & weaknesses of #EIA2006 notification?
e)How would #draftEIA2020 notification build upon d strengths of #EIA2006 & proposes to address its weaknesses?

Unfortunately there is nothing in d public domain to suggest that such an exercise was even thought of @moefcc.
What we find instead in #draftEIA2020 r ref to few court directions & use of vague terms like
delegation, rationalisation & standardisation as reason for it?

WAY FORWARD
Accordingly it is @water_conflicts (on whose behalf this research was done) suggestion that
#DraftEIA2020 Notification deserves to b #recalled.
Central government @moefcc need constitute an expert committee headed preferably by a former judge of the Supreme Court +

with an eminent Environmentalist as a Co-Chair & having representatives in it from various relevant sectors (including civil society) to deliberate in a scientific, transparent, participatory & time bound manner on “what should be an appropriate

(that also fulfils India’s international commitments made at Rio Earth Summit, 1992 etc) EIA governance legislation and institutional structure in d country to replace d existing one”?
Pending results of d deliberations of d said expert committee, let #MOEFCC remove immediately

through executive action d following infirmities which are present in #EIA2006 notification:
a)EIA reports on proposed projects to b not commissioned by d project proponent (PP) but by d @moefcc itself through a transparent process utilizing d money deposited by the PP into a

central kitty held by the central government. This shall take away d inherent conflict of interest (master-servant relationship between d #PP and d #EIAconsultant) existing in d current process.
b)Do away with d practice of entertaining any ‘rapid’ EIA of projects.

c)Resolve the question of non inclusion of specific projects/activities like #Railways/Metro; #Inland #waterways #transportation (IWT) projects; Raising of #Embankments along rivers & large sized bridges / elevated roads across rivers within d #Schedule.
