⚠️ IMPORTANT re the Trump/GOP lawsuit to strike down the #ACA:

--Yes, the case will be *heard* by the Supreme Court on Nov. 10th.
--However, the actual *ruling* in the case isn't expected until next spring.

THIS IS VITAL FOR SEVERAL REASONS: 1/

1. First, this means the *2021* Open Enrollment Period, which starts on *November 1st*, is still on and 2021 policies *should* still be valid thru the end of next year.

2. More importantly, it buys Dems time to make the case moot--but ONLY IF THEY WIN A TRIFECTA THIS YEAR.

If Dems #KeepTheHouse, #FlipTheSenate *and* #KickTrumpOut, they should time to pass & sign a simple bill which would do one of three things:

1. Reset the federal penalty to $1 or higher,
2. Explicitly state the mandate is severable, or
3. Strike out the mandate language itself

Any of these should immediately resolve the issue before SCOTUS even issues their ruling. Ideally, they should pass a law doing both #1 and 2...but there could be issues w/the filibuster and/or reconciliation which make one of the three more practical.

There's been a lot of back & forth about whether @HouseDemocrats should go ahead & pass such a bill *before* SCOTUS hears the case, even knowing it'd go nowhere in the Senate under GOP control. I was neutral on the issue myself--I could see arguments--until #RBG passed away.

Since her passing, the argument *against* passing the bill through the House only has become weaker, so I immediately became a supporter, though I still understand the risk of doing so.

However, it looks like @SpeakerPelosi is sticking to her guns. It doesn't look like such a bill is gonna pass the House between now & 11/10, and there'd be zero point in doing so during the Lame Duck period anyway, so the time to do so is sometime in January - March.
