A story I wrote a couple days ago: How to know if a presidential candidate claiming victory has actually won the election. A reminder that a candidate falsely declaring victory has no legal weight and has no bearing on the canvassing process
businessinsider.com/trump-biden-pr…
Everything the president just said is completely nonsensical and incoherent. He's claiming he's winning...and yet wants the counting to be shut down — people who are legitimately winning/won wouldn't need for that to happen
This is also true — you can't just go to the Supreme Court and be like "hey I don't like the fact that these ballots are being counted, pls make it stop." There's def the possibility for future litigation but these cases have to move up through the system
This is the thing — it’s *much* harder to get votes that have already been cast disqualified after the fact than to change the rules beforehand, especially when you didn’t raise the issue in court before the election or did and lost the case (this gets to the doctrine of laches)
I don’t know what his legal avenue would be re: trying to get mail ballots tossed in Michigan and Wisconsin — courts have already sided with his position in ruling that mail ballots in those states needed to be received by the time the polls closed on Election Day!

hello! While we're waiting for more presidential results, I thought I'd give you an update on the House. @DecisionDeskHQ projects that Republicans have won back 5 seats on net so far. Rs flipped 7 seats and Dems won back 2 thanks to redistricting in NC businessinsider.com/2020-house-ele…
Seats projected to flip D to R, per @DecisionDeskHQ

#IA01 ( Finkenauer)
#FL26 (Mucarsel-Powell)
#FL27 (Shalala)
#MN07 (Peterson)
#NM02 (Torres Small)
#OK05 ( Horn)
#SC01 (Cunningham)

Others to keep an eye on as more votes are counted: #CA21, #CA39, #NY11, #NY22, #UT04
Democrats have also fallen short on many of their offensive targets to flip R-held seats: their most promising pickup opportunity is #GA07, where @decisiondesk HQ has not projected a winner and we should (hopefully!) get more clarity today as more votes are counted/reported

A must-read from Ben Ginsberg & Bob Bauer: "Despite all the 2020 rhetoric, this country has a solid system to count votes; to adjudicate allegations of fraud, irregularity or error; to provide avenues for resolving close elections; and to declare winners." washingtonpost.com/opinions/2020/…
"The president has notably failed to produce any evidence of systemic fraud to support his claims. He has ignored the fact that Republican observers have witnessed voting in every election and have discovered fraud only in rare, isolated incidences." washingtonpost.com/opinions/2020/…
"The process to overturn an election would require specific evidence proved on a precinct and county level. Blanket challenges won’t work. Bombastic rhetoric at a rally or a television interview is far from sufficient." washingtonpost.com/opinions/2020/…
