Karnataka HC begins hearing a plea challenging the downloading and use of Aarogya Setu App to access public services.

Senior Adv Colin Gonsalves appearing for the Petitioners submit that there are 135 notifications issued by GOI and companies which say that Aarogya Setu App is mandatory. These have not been withdrawn.

Data collected with authorisation of law is illegal. I want them to advertise and tell the country that the App is voluntary, Gonsalves.

For final hearing, I want them to DELETE all the data that they have collected and give it back to the respective persons, Gonsalves.

Gonsalves refers to Puttuswamy Judgment now.

He refers to the 9 privacy principles in the Puttuswamy judgement.

This data collected is given to all EMPLOYERS across the country for them to conduct surveillance of their employees.

This datta is also given to PHARMACEUTICAL COMPANIES to find out what illness etc I have. The data should not be collected for commercial purposes, he submits.

Name, phone, age sex, countries visited - this is the preliminary data that the Administrator of the App can view, Gonsalves.

How does the App work? When does it keeping changing colour like orange, red? The Bench asks

Privacy policy of the App and data collected - I want to speak on this now, Gonsalves. He reads the said policies.

The Bench says the hearing of matter can be continued on Nov 12, at 12:45 pm.
