“Can Pence Throw out votes?”
No. The Constitution says Pence opens all certified votes and then announces them, and asks for objections.

That's it.

The ECA only adds two things: Pence asks for objections, and maintains orders.

That's it.

The main thing you need to know is that the law says that the electors that were certified by the states before safe harbor day “shall be conclusive”.
“But can’t electors be objected to?”

Yes! But once that happens, it goes to a separate vote by the House and Senate
“But aren’t there alternate Electors?”

No. The law is very clear, the Governor of each state must certify them and ensure they get to the National Archives, who then sends them to the Vice President. Look at the National Archive list for yourself:

Since it’s a joint session, they should just kick Pence out and have the Pro Tempore of the Senate (Chuck Grassley) preside

Senate PT have presided over the counting of the electoral votes at least twice before, 1857 and 1969
So what do I expect to happen?

Not much really, I expect the votes to be opened and counted, and when Pence asks for objection, there will be a sustained objection and both houses will retire to debate for two hours and then vote

Pence will then announce Biden as the winner.

Yes.

But that doesn’t mean WE can’t have fun!

(In the back of my mind I see Pence resigning, but I doubt it)

So let's take a look at some cool moments in Electoral College history! These will also give you a good idea of how things will happen today.
1857: We tune into the joint session of Congress where there is a tense debate going on.

Senators are objecting to the counting of the votes by the Presiding officer. They ask the tellers for a count, and are informed that the tellers forgot to count!
1981: Walter Mondale announces his own defeat to Ronald Regan (on his own birthday no less), what a gem of a moment!

Reagan gets a lot of credit for his humor, but this guy knew how to take a joke

1989: The teller reading the Arkansas vote forgot one tiny detail...
2001: Al Gore

I'm not familiar with joint session parliamentary rules, but I believe they can just vote to remove the presiding officer.

The Presiding officer is just that, presiding, he's just there to keep the meeting moving and maintain order.

Okay, they are starting to announce the Electoral votes. Pence asks for any objections (this is unusual, usually there are only objections at the end)

Chuck Schumer speaks now as Minority Leader. He is laying out the law and the responsibility of the Senate to reject this effort.
Their delusion continues.

They don't want to admit that Trump lost, and lost bigly. They want someone else to blame.

Ted Cruz is now speaking, and apparently because people believe the election is fraudulent they should have a commission.

He brings up 1876, but ignores the law written in 1887 which addresses the problem facing Congress!
Trump says "we have a responsibility to count the votes" but ignores that counting does not mean not counting.

Tuning over to Fox, looks like capital police are charging the ground, they are evacuating people from Capitol Grounds
Foxnews "Some part of this crowd tried to break the barriers to the capitol"
And there was a "suspicious package" according to fox which lead to the evacuation. Probably just a precaution
To be clear, this was just an evacuation of the grounds, not the building, Senate and House still debating inside
People are charging the east side of the capitol, they are trying to storm the building, NBC news
Blood and injuries are being report. They are on the steps right now. There will be a response from Capitol police at some point Image

Pence has left the Senate chambers, not sure if that is in regards to the security threat. It's also not necessary that he stays, the debate is still ongoing.

For anyone who is wondering, there are many underground passages from the Capitol building (there is even an underground tram). They extend all over the National Mall, so that is how the Senators and Reps have left the Capitol. Image

Regarding the military:

1) There is understandable hesitancy about sending them in during a discussion about the election.

2) I'm glad I don't have to make this decision.

3) This has become a threat to the stability of our nation.
NBC is reporting that a person was shot by law enforcement, assuming it's the same person as the last tweet mentioned.
This will go down, in my mind, as the most memorable day in American history since 911.

They destroyed any chance of the election being delayed (not that that chance was high)

25th Amendment Summary #1

Okay, so the 25th really isn't complicated. If the Vice President and a majority of the cabinet decide that the president is unfit for office, they will let the Senate and House know. Image

When they let Congress know, the Vice President IMMEDIATELY takes over the the responsibilities of the President.
25th Amendment Summary #3

If the President contests this, The VP and cabinet and leaders of Congress must say "nope, sorry!" within four days.
25th Amendment Summary #4

Congress then has 21 days to vote. For the 25th amendment to stick, both houses must have 2/3rds majority.

So potentially, they could just wait out that time, avoiding needing that 2/3 majority

One thing to note, they have to assemble within 48 hours to discuss the issue, but they don't have to vote.
While I was away, Lyndsay Graham poked fun at the idea that Pence could alter the election.

They are also counting up the votes on the motion to contest Arizona
Essentially, the 25th means that Pence and the Cabinet could remove Trump immediately, and then Congress just has to play along and let Trump's term expire. They wouldn't need the 2/3 majority

Pence would be acting president for that time.

So back to the Electoral College, they are voting in the house, current vote against the Electoral slate of Arizona is 62.
There are a couple things that can happen.

1)Remove their committee assignments
2)Censure
3)Removal

First one is likely to happen if they keep objecting. The other two are pretty unlikely
Correct, both Houses must agree to throw out an electoral slate. This is purely parliamentary.

We are hearing that there will be another objection later, but that Congressional leader say that they will absolutely finish this tonight.

One thing to note, that there are significant Republican leaders who are holding Trump accountable for the riots.

This will come into play if there is in fact a Trump removal planned tonight

No. By law the objections are allowed to be made. Each side has half the time allocated to it, so I doubt more than one or two Democrats will speak. How the House Minority leader divides the time up determines how long this will take.

I want to wrap this thread up. I don't know where to begin, I don't know where to end.

I had no idea that I would still be updating it 24 hours after I started it.
I consider my Americanness to be secondary to everything else. My faith, my family, my political philosophy, my personhood, all define me more than where what country calls me it's citizen.
I learned yesterday that my American identity was still deeply rooted in my psyche. I felt like that it was MY Capitol they were attacking, MY representatives they were targeting, MY rights they were threatening.
January 6th 2021 will be emblazoned on my memory second only to 9/11.

In a few years, just like it always does, the memory will fade and the pain will dull.

We have forgotten the lessons of 9/11, but we 𝘤𝘢𝘯𝘯𝘰𝘵 afford to forget the lesson that January 6, 2021 taught us.
January 6, 2021 taught us how fragile our democracy really is: we are only as strong as the people we elect.

It should not be that way
We need to strive for a government that empowers the people and restricts the politicians AND their cronies. .

In my opinion the only political party that is truly working to that end is the Libertarian Party.
- Ending Qualified Immunity and Civil Asset Forfeiture
- Ending the war on drugs
- Ending all wars
- Ending crony “capitalism”
- Reforming occupational licensing
- Reforming Immigration

There is only one party that is firmly in your corner on these issues, and it’s @LPNational
Regardless of what party you prefer, Jan 6th should show us that we 𝘮𝘶𝘴𝘵 vote for the men and women who want to give the power over your life back to you.

You should not be beholden to your government, your government should be beholden to you.
I believe that the candidate always matters more than the party they belong to.

Make sure the candidates you vote for are willing to let you have the power when the next Jan 6th happens.

Okay, a few thoughts on Impeachment I want to get out there.

First and most important:

It's the right thing to do.
