CJI bench allows a petitioner to approach court under Guardianship & Wards Act:
CJI SA Bobde: Dekhiye, hum aapko criminal case chalane ki permission nahi de sake. Aapko Guardian and Ward Act ke under custody lena hoga. (We cannot allow criminal case to proceed)
Adv Nidhi: I am for the party but I was discharged from the case.
CJI: there can be no case against the Nana (grandfather) what is wrong with nana. You cannot get custody in prosecution. We will stop this prosecution and allow custody plea to carry on
CJI: Maternal grandfather and unclea of the child is being prosecuted for offences. Even though there are criminal charges levelled in respect of custody of child, essentially we are of the view that respondent will pursue the custody under the Guardianship and Wards Act
CJI: It is not appropriate for prosecution to carry on against the maternal grandfather. Prima facie its not possible to attribute criminal act to the maternal grandfather.
CJI: we accordingly quash the FIR against the grandfather. The father will now file for custody in the trial court under the Guardian and Wards Act. Order accordingly
