3. The Constitution of Kenya is inoculated from the mischief of those (eg. The Handshake Bros) who would "design" a "popular" initiative - using state resources - in the form of an amendment bill that alters fundamental underpinnings of the COK.
4. President Uhuru Kenyatta cannot be both PLAYER and REFEREE. He cannot argue that he was acting as a private citizen, eg. Wanjiku. This is part of the #BBI hoodwink.
6. The President can be sued for constitutional violations.
The President initiated the BBI Tasforce β‘οΈ Steering Committee himself. It was NOT a popular initiative. The Steering Committee was unconstitutional.
8. Meaningful public participation has primacy in the supreme law of the land.
Public participation is not about lip service & [coerced] signatures. In fact, copies of of the BBI amendment bill were neither distributed nor translated.
9. President Uhuru Kenyatta failed to respect, safeguard & uphold the COK and instead, sneakily stretched his authority to initiate a proposal to amend the Constitution. See Article131 Sub Article 2(c) & Article 132.
11. Article 89 is part of the basic structure but not an eternity clause - meaning that additional constituencies CAN be proposed. However, it is an unconstitutional short circuit by the Bill to delimit 70 new constituencies. Hii ni kazi ya @IEBCKenya. Na Wanjiku.
12. @IEBCKenya's decisions related to the Constitution Amendment Bill including collection of signatures & constitutional thresholds are invalid, null & void. Lack of statutory quorum. Quorum of 5 commissioners is not cosmetic.
13. @IEBCKenya abdicated its precedented responsibility to not only confirm the receipt 1million signatures but ALSO to verify the signatures as belonging to registered voters.
Its administrative procedures are INVALID. No Statutory Instruments Act. No Wanjiku.
14. Article 43 focuses on our economic & social rights. #BBINonsense is ill timed as we are in the middle of a pandemic #COVID19. We can neither afford the health impacts of #superspreader rallies nor the expense related to a referendum.
-Basic Structure Doctrine is applicable
-Public participation is key
-Popular initiatives belong to Wanjiku
-The President can be sued, cannot drive a popular initiative & has violated Ch 6
-BBI Steering Committee is unlawful
-IEBC actions unlawful
Diaspora member @KaranjaMatindi (UK), the 2nd interested party, this morning filed a fresh application under a Certificate of Urgency for conservatory orders to prohibit President Uhuru from directing @IEBCKenya to conduct a referendum on BBI.
2. Until the Diaspora Voting Registration case E069/2020 filed by another Diasporan James Gitau (USA) is heard and determined. It prays for prohibition of IEBC from conducting any Election until it complies with the SCOK orders of 2015 & COA orders of 2014.
3. The SCOK & COK ordered the registration of the Diaspora as voters and file annual reports to National Assembly & the Senate. The passage of the BBI Constitution Amendment Bill (2020) by both Houses of Parliament Mbunge will render the instant suit moot.
2. The #BBI hoodwink says the WaKenya have overwhelmingly cheered in support of the mutilation of the COK. That Legislators are humbly heeding the call of their electorate.
2. Circa 2013-14, @MOH_Kenya envisioned a 7-10yr Public Private Partnership (PPP) to equip 94 Level 4 & 5 hospitals across 47 counties. This was approved on 22 Jan, 2014.
The PPP was ditched by June 2014 & an international Open Tender MOH/001/2014/2015 was launched.
3. As bids were submitted, the PPP under the Public Private Partnership Act, 2013 morphed into a Managed Equipment Service (MES) under the Public Procurement and Disposal Act, 2005 (repealed), now the Public Procurement and Asset Disposal Act, 2015. No justification.
1. Pres. Uhuru Kenyatta & relatives 2. Murathe, Megascope & that motley crew 3. Governors & "their people"
These quick-to-absolve-myself-and-my-party are premature. What about their Governors & Legislators?

2. Even as @USAID@GlobalFund threaten to withdraw / procure directly, they know that for 6yrs, they funded KEMSA to the tune of Sh23B p.a. @Deloitte won the contract from Supply Chain Management System (VA) to clean up the mess.
2. Although not common, it isn't unheard of for people to continuously test positive for #COVID19. Esp those who were symptomatic. I seem to be one of them.
Perhaps I had a heavy viral load that is taking a while to clear from my system.
Symptoms are gone.
Just recovery.
