#BackToSchool The Supreme Court of the United States (SCOTUS) is the highest court of our land. The 9 justices decide the constitutionality of our laws and they hear select cases as a court of last appeal. Since Presidents pick nominees, elections & voting matter a great deal!
Article III of the Constitution establishes the federal judiciary. Article III, Section I states that "The judicial Power of the United States, shall be vested in one supreme Court, and in such inferior Courts as the Congress may from time to time ordain and establish."
2/19
Although the Constitution establishes the Supreme Court, it permits Congress to decide how to organize it. Congress first exercised this power in the Judiciary Act of 1789. This Act created a Supreme Court with six justices & established the lower federal court system.
3/19
Over the years, various Acts of Congress have altered the number of seats on the Supreme Court, from a low of five to a high of 10. 4/19 #SCOTUS#backtoschool#DemsWork4USA
Shortly after the Civil War, the number of seats on the Court was fixed at 9. Today, there is one Chief Justice & 8 Associate Justices. Like all federal judges, justices are appointed by the President & are confirmed by the Senate. They, typically, hold office for life. 5/19
Article III, Section II of the Constitution establishes the jurisdiction (legal ability to hear a case) of the Supreme Court. #SCOTUS#backtoschool#DemsWork4USA
The Supreme Court has original jurisdiction (a case is tried before the Court) over certain cases, e.g., suits between two or more states and/or cases involving ambassadors and other public ministers. 7/19 #SCOTUS#backtoschool#DemsWork4USA
The Supreme Court has appellate jurisdiction (the Court can hear the case on appeal) on almost any other case that involves a point of constitutional and/or federal law. 8/19 #SupremeCourt#backtoschool#DemsWork4USA
When exercising its appellate jurisdiction, the Court, with a few exceptions, does not have to hear a case. The Certiorari Act of 1925 gives the Court the discretion to decide whether or not to do so. 9/19 #SCOTUS#backtoschool#DemsWork4USA
In a petition for a writ of certiorari, a party asks the Court to review its case. The Supreme Court agrees to hear about 100-150 of the more than 7,000 cases that it is asked to review each year. 10/19 #SCOTUS#backtoschool#DemsWork4USA#Democracy
The best-known power of the Supreme Court is judicial review, or the ability of the Court to declare a Legislative or Executive act in violation of the Constitution, is not found within the text of the Constitution itself. 11/19 #SCOTUS#backtoschool#JudicialReview
The Supreme Court established this doctrine in the case of Marbury v. Madison (1803).
In this case, the Court had to decide whether an Act of Congress or the Constitution was the supreme law of the land. 12/19 #SCOTUS#backtoschool#DemsWork4USA
The Judiciary Act of 1789 gave the Supreme Court original jurisdiction to issue writs of mandamus (legal orders compelling government officials to act in accordance with the law). #SCOTUS#backtoschool#DemsWork4USA
The Supreme Court plays a very important role in our constitutional system of government. First, as the highest court in the land, it is the court of last resort for those looking for justice. 14/19 #SCOTUS#backtoschool#DemsWork4USA#democracy
Second, due to #SCOTUS power of judicial review, it plays an essential role in ensuring that each branch of government recognizes the limits of its own power. 15/19 #backtoschool#DemsWork4USA#democracy
Finally, it sets appropriate limits on democratic government by ensuring that popular majorities cannot pass laws that harm and/or take undue advantage of unpopular minorities. 17/19 #SCOTUS#backtoschool#DemsWork4USA#democracy
In essence, #SCOTUS serves to ensure that the changing views of a majority do not undermine the fundamental values common to all Americans, i.e., freedom of speech, freedom of religion, and due process of law. 18/19 #backtoschool#DemsWork4USA#AmericanValues
As Americans, we need to understand how our judiciary is designed to function to protect our democracy, our values & our human rights. We need to demand the highest court in our land be beyond political influence. Vote wisely to ensure our justices are chosen with due care. 19/19

When the system is overwhelmed, the President should have emergency authority to expel migrants who are crossing unlawfully and stop processing asylum claims except for those using a safe and orderly process at Ports of Entry. 1/16 #DemPartyPlatform2024 #BorderSecurity
The authority should be accompanied by humanitarian exceptions for vulnerable populations including unaccompanied children and victims of trafficking. 2/16

#Congress should also dedicate resources to detain and remove individuals quickly, and rapidly process those who cannot be detained in a non-custodial setting under government supervision. 3/16 #BorderSecurity #Harris_Walz2024 #DemPartyPlatform2024
President Biden, Vice President Harris, and #Democrats know that democracy has always been America's sacred cause. Whether that's still true is the most urgent question of our time, and it's what the 2024 election is all about. 1/15 #DemPartyPlatform2024 #ProtectOurDemocracy
America is the only country on earth built on an idea: that all people are created equal. We've never fully lived up to that, but we've never walked away from it, either. And we won't let Donald Trump and MAGA Republicans walk away from it now. 2/15 #DemPartyPlatform2024
The President, Vice President, and all #Democrats will continue to work every day to ensure that our democracy endures.President Biden has put protecting American democracy at the heart of his presidency. 3/15 #ProtectOurDemocracy #Harris_Walz2024 #DemPartyPlatform2024
For too long in this country, too many communities have been denied the basic security and dignity that comes from having clean air, clean water, and functioning infrastructure. 1/16 #DemPartyPlatform2024 #EnvironmentalJustice #Harris_Walz2024
Too many parents still lay awake at night worrying what the rain or soil or water or air is doing to their kids. That kind of inequity goes against everything that we stand for as a nation. 2/16 #DemPartyPlatform2024 #EnvironmentalJustice #Harris_Walz2024
To finally change that, the Biden/Harris climate agenda includes the most ambitious environmental justice actions in history, making sure that the people who've suffered most from legacy pollution can now share in the benefits. 3/16 #DemPartyPlatform2024 #EnvironmentalJustice
Today, corporate consolidation is allowing companies to keep raking in historic profits, while continuing to raise prices for working families. 1/13 #DemPartyPlatform2024 #CorporateConsolidation #DemocratsDeliver #HarrisWalz2024
In the two decades before President Biden & VP Harris came to office, three-quarters of American industries grew more concentrated. As the President often says, capitalism without competition isn't capitalism, it's exploitation. 2/13 #DemPartyPlatform2024 #Competition #DemsAct
And the American people are tired of being played for suckers. The Biden/Harris Administration has taken historic steps to boost competition across our economy, in fields from finance and farming to technology and transportation. 3/13

American farmers are the backbone of our country. They feed America, and help feed the world. But over the years, trickle-down economics has hit rural America hard. 1/13 #DemPartyPlatform2024 #farmers #agriculture #HarrisWalz2024
#Farming costs have gone up & incomes have gone down.Big Agriculture moved in,telling too many small farms that the surest path to success was to get big or get out. As a result, we lost over 400,000 farms in the last 40 years, & rural communities have paid a steep price. 2/13
Too many young people have had to leave their hometowns to find good-paying work & a shot at their dreams.
#Democrats believe that no one should have to leave the community where they grew up just to find opportunity. 3/13 #DemPartyPlatform2024 #Agriculture #YoungPeople
At the start of the Biden-Harris Administration, in the midst of the worst economic crisis in 100 years, experts feared a stagnating recovery and even worried about a new recession. 1/11 #DemPartyPlatform #HarrisWalz2024
But #Democrats chose to put workers first, and instead of recession, America has seen remarkable strength and resilience. Our economy grew by 3.1 percent last year – the fastest rate of any major economy in the world. 2/11 #DemPartyPlatform2024 #HarrisWalz2024 #EconomyMatters
#Democrats added nearly 16 million jobs – not only recovering all the positions lost during Trump's botched handling of COVID, but also adding 6.3 million more than existed before the pandemic – surpassing pre-pandemic projections for the labor market. 3/11 #HarrisWalz2024
