[Suo Motu case: dignified handling of COVID dead bodies]

In the previous hearing, the top court had pulled up the Gujarat government for failing to follow its directions with regard to fire safety norms in hospitals #supremecourt #suomotu #covid19

Referring to a notification issued by the government effectively stating that hospitals do not have to adhere to the norms till June 2022, the Bench of Justices DY Chandrachud and MR Shah said,

"Once a mandamus is there, it cannot be overridden by an executive notification."

Justice Chandrachud: Mr Solicitor, we have no recieved the report of the commission

SG Tushar Mehta: It was submitted in sealed cover. I can supply from my office

Justice MR Shah: Now Gujarat govt has come out with clarificatory notification.

Justice Shah: notification can be issued in furtherance of town planning act and not to stay the provisions.

Justice Chandrachud: serve it upon my office. We will hear it next Monday

SG Tushar Mehta requests for an adjournment in the case of Anup Majee vs CBI which is slotted for tomorrow due to other cases slotted

Adv Pranjal Kishore: We have filed a recall application since they have said no action will be taken against them who violate the fire safety norms.
