Judge Hogan: They were there at an anti-vaccine protest, in a different place. They came on later to the Capitol. They came to the riot, and it was a riot. People died. Yesterday another Capitol Police officer committed suicide.
Judge Hogan: This case is unique, though. They went in after the riot had begun... No prior criminal record, a mechanic, then into real estate business which he has lost as a result of this charge. Now they have notoriety. There's separately from family.
Judge Hogan: There's separatION from family... Relocate to a new community. Mr. Bustle has worked all his life, since a teenager. Ms. Bustle was employed. But as to the nature of the sentence, this is a misdemeanor, a Class B. The maximum sentence is six months
Judge Hogan: The nature of the attack was unique in the history of this country. The last time was the War of 1812, British burned it. In this case, a group of individuals misled by false claims of a fraudulent election tried to take the law into their own hands
Judge Hogan: Some have suggested there should be a matrix on how to sentence these cases.
Voice: The judge's feed has frozen.
Judge Hogan [he's back] .. there were signs of damage in the area. Windows were smashed... Individuals have to be treated individually. In this case, a probationary sentence should not become the default. I considered giving time, but this is not the case.
Judge Hogan: I am going to sentence Mr. Bustle...
Joshua Bustle is sentenced to 24 months probation, 30 days home confinement. 40 hours community service.
Judge Hogan: Home confinement means you can only go out for work, religious services and the like.
Tim Anderson for Mr. Bustle: Mr. Bustle and his wife are moving to South Carolina, the movers are coming August 14. So we ask for a delay in home confinement.
Judge Hogan: Now Ms. Bustle. I think you should be entitled to probation, despite your posts on social media. You having to move is substantial punishment. I believe you have remorse. I considered putting you in jail, because your statements concern the court.
Judge Hogan: Your statements about patriots are so misguided. Patriots do not attack operations of Congress and attempt to stop them. I sentence you to two years probation, home confinement of 60 days, your actions were more serious than your husband's.
Judge Hogan: Restitution to the Department of Treasury of $500, $200 a month until paid. Also community service, same length as your husband's. I'm not going to lecture you on your vaccine status...

OK - now detention review in Jan 6 case of US v. NICHOLAS LANGUERAND, before DDC Judge Bates. Inner City Press, still waiting for DOJ videos in US v. Harrelson (Mehta), will live tweet, thread below
Languerand's lawyer: My client has grandparents in South Carolina who would have him.
Judge Bates: Didn't he live in Vermont? What are his roots in South Carolina?
Defense: His grandparents moved and asked him to come down once he lost his job. He's a hard worker
Languerand's lawyer: He digs footings for foundations, his former boss would love him back. The risks to the public could be addressed by turning in the weapons that the government discovered - and did not seized, mind you. He could be on a curfew.

Judge Mehta: Are there legal terms you do not understand?
Lolos: Some might come up.
Judge Mehta: Were you both in the US?
Lolos: Yes.
Judge Mehta: Do you wish to plea guilty to picketing or parading in the Capitol Building?
Lolos: If you're saying it, yes.
Judge Mehta: The plea agreement is nine pages?
Lolos: Yes. I have a request. On page 6, the 2d paragraph, it says I'm required to provide standard financial info. I can pay the fee. Why are my financials relevant to a misdemeanor case?
OK - in crypocurrency case of US v. Reginald Fowler, now a proceeding before @SDNYLIVE Judge Carter. Inner City Press has covered the case innercitypress.com/sdny19cryptofo… and will live tweet, thread below
Judge Andrew L. Carter: The parties have proposed a briefing schedule, and I'll sign off on it. They have requested a trial date in early February 2022. I can't guarantee the date, due to COVID. There's a committee in the Court, defendants in custody have priority
Judge Carter: In December I can request Feb 14, then we'll know yes or no in January. Or we could try one mid April. I did a trial recently [Bob King, being sentenced today: innercitypress.com/sdny16bobkingp…] In April, maybe I could do it in my own courtroom

Follow the Money: Briber/cooperator Jonah Rechnitz had been ordered to pay restitution to COBA of $500,000 a year. But then he whipped out $7 million in diamond. So today, @SDNYLIVE Judge is moving toward ordering him to pay $7 million, then $250,000 a quarter.
Judge Hellerstein: Mr. Rechnitz pays $17,000 a month in rent... How does he have a Bugatti? It's very dis-spiriting. He told me he would be a different person. But it seems he's the same. He conned me.
Judge Hellerstein: I've had to rethink these criteria, and come up with a solution that gives a chunk of money to COBA presently, has an adequate installment period beyond that, and perhaps gives discovery rights to COBA.
