Sunita Duggal, BJP speaks on Family Court Amendment Bill:
- Family Courts, 1984 Act provided for Family Courts to be set up by State Govts in consultation with High Court, through notification by Cental Govt
- In Himachal Pradesh, Nagaland courts were set up but w/o notifications
Duggal continues:
- These courts could be declared null & void, many families, people employed there would suffer
- Therefore, this Bill retrospectively establishes Family courts in nagaland and himachal pradesh & validate all actions taken by state govt for these courts
Duggal concludes by demanding more Family Courts be opened in other states.

Bhartruhari Mahtab, BJD states that Omkar Sharma v. State of Himachal Pradesh case responsible for the amendment. Asks why Central Govt didn't issue notification, courts had to point out.

The 1984 Act came 30 yrs after Hindu Marriage Act 1955, because need for such courts was felt, but many cases, need to provide for conciliation
Ritesh Pandey, BSP on Family Court (Amendment) Bill:
- lost opportunity, changes could have been brought in Bill to address other issues wrt family courts
- 1984 Act requires that for appointment of judges in family courts, preference given to women, but very few women judges
Pandey on Family Courts Amendment Bill:
- only 30% women judges in lower courts, 5% in higher courts
- this amendment should have encouraged more women representation, Women must be part of every court that involves their cases
- increase women in lower courts, magistrate level
Dr. Sanjeev Kumar, YSRCP on Family Court Amendment Bill:
support Bill
Points out issues:
- different states have different rules, if married in one state, living in another, where to go
- Family Court not empowered to curb domestic violence
- No training given to lawyers, judges
Jayadev Galla, TDP on Family Courts Amendment Bill:
- Discrimination against fathers in custody cases & delay in judgments imp roadblocks in family courts
- Lack of infrastructure, shortage of judicial officers
- 11.7 lakh cases pending in family courts

- 235 more family courts supposed to be set up in 2015-2020, but not followed through
- Marriage Counsellors should be on permanent basis not temp
- Gender sensitivity needed
- Procedure should be simplified for speedy justice
- Judges can also act as counsellors

- uniform time limit to resolve family disputes needed
- 716 family courts in country, more needed
- Family courts should also take up cases regarding abandoned senior citizens.

- Family courts must include mens rights, also ensure that dowry act not misused
- How many women benefitted from triple talaq judgement?

Criticizes SC for striking down S.377, criticizes live in relationships, same sex marriages, S.498 IPC misused.
Argues that population control about women health.
St Hasan, SP on Family Courts Amendment Bill also asks if legalization of homosexuality part of Indian culture, cruelty law misused.
Other points raised by MPs:
- court infrastructure inadequate
- counselling centres with experts needed
- divorce cases take too long, women suffer

Both Houses get adjourned to 12pm within minutes
But in #LokSabha, an important question on 'Regional Benches of Supreme Court' gets discussed amid protests.
One MP asks if separate benches to deal with crimes against women will be considered....
Law Minister Kiren Rijiju says - agree with the sentiment, but not related to the main Q.
Another MP refers to Law Commission report which had recommended 4 regional benches of SC & division of SC into Constitutional division & legal division, says crores of cases pending.
She also referred to setting up All India Judicial Services.
Law Minister Rijiju responds - Law Commission has submitted 3 reports, recommending regional benches of SC in east, west, north, south but various views on that, SC in its 2010 judgment rejected this suggestion....
