The Supreme Court in its Aadhaar judgment had struck down that part of Sec. 57 of the Aadhaar Act which enabled private entities to use authentication services calling it unconstitutional. The court held that this enabled commercial exploitation of biometric and demographic data.

On December 20, 2018, the Ministry of Home Affairs issued a statutory order authorizing 10 agencies to intercept, monitor and decrypt communications of citizens. The order may be read, here - bit.ly/2rYlx0z #Surveillance
The agencies authorized by MHA include - Intelligence Bureau, National Investigating Agency and Commissioner of Police, Delhi. The order was issued under existing powers given to the MHA as per Section 69 of the IT Act, 2000 and corresponding rules. #Surveillance
Section 69 empowers the govt. to issue directions for surveillance of communications. The corresponding rules empower the MHA to notify other govt. agencies which can perform such surveillance. Thus, these agencies have been notified under existing rules under the IT Act.

The Indian Supreme court today is hearing petitions challenging the "constitutionality" of Section 377 of IPC that outlaws homosexuality

One of the key points of the petitioners is that the law is quaint and smacks of "Victorian morality"

But what exactly is Victorian morality?
There is a tendency in our times to use words unthinkingly. The term "Victorian" is one such word, which has lost nearly all of its original import.

Today anyone who is prudish, conservative or "old fashioned" so to speak is labeled "Victorian"
The term Victorian as we know strictly refers to the era in history between 1837 and 1901 - a 64 year old period when Queen Victoria was the monarch of Great Britain.

Court is back in session: ACLU wants longtime ACLU attorney and local member Bruce Kramer to testify to clear up some of the discrepancy about the history of the West TN chapter. Problem is...
Kramer has been sitting in court all morning and he’s the attorney for the four plaintiffs who were dismissed because the judge decided they didn’t have standing.
Looks like Kramer is going to leave now and get deposed later tonight. Defense isn’t liking this at all, but they’re not protesting too much. Judge is directing Kramer to produce any relevant documents.

Centre today put the onus on the Supreme Court to decide on the criminality of the Section 377 of the Indian Penal Code(IPC), which criminalises consensual gay sex
Submitting affidavit in the apex court, Additional Solicitor General Tushar Mehta told the five-judge constitution bench that the Centre will leave the matter of constitutionality of Section 377 to be decided by the Apex Court.
The Centre said it has no objection with the court dealing with the validity of this penal provision.

This morning, the Supreme Court ruled that citizens challenging partisan gerrymandering of Wisconsin's legislative districts hadn't proven they had grounds to sue. I want to say a little bit about the ruling, because it's gonna be a big deal going forward.
In the US court system, you can't just bring a case against the government because you don't like something they're doing. You have to prove what's called "standing."
In a gerrymandering case, that means you have to prove that you've been harmed by the district lines as they're drawn. But SCOTUS has no clear rules on partisan gerrymandering, so proving that harm is difficult. It's a bit of a Catch-22.
