5th Cir.: Not clearly a 4th Am. violation for police officers to tase an intoxicated middle-aged man who was unarmed, nonviolent, had not disobeyed officers, and was standing in his underpants in the middle of the street on a cold night.
Going forward, however, the 5th Cir. says police officers in Louisiana, Mississippi and Texas are on notice that they may not constitutionally tase erratic but unarmed, nonviolent people who aren't suspected of crimes.
