Important Note: The Supreme Court tonight allowed an execution to proceed in Alabama against the ruling of one appeals court and kept a Louisiana law from going into effect against the ruling of another one. In both cases, the 5-4 majority provided no reasoning for its decision.
In the death penalty case, the dissenting justices explained their opposition (through a dissent from Kagan, joined by the others). In the abortion provider case, only Kavanaugh wrote to explain his opposition to the stay and only for himself.
A fair caveat to this in the death penalty case is the unsigned order, which I guess technically has to have been agreed to by the 5 non-dissenting justices in order for it to be a majority of the court. It says Ray's having "waited until January 28" is the court's reason.
Nonetheless, no one signed their name to it, and its not really the fulsome reasoning one expects before a court votes to allow an execution to proceed.
