Judge Rao is an excellent addition to the DC Circuit Court of Appeals, but she should recuse from a case this closely tied to the personal finances of the man who appointed her just months ago.

Judge Rao is a person of high integrity. People who know her would trust her to be impartial in this case. But that’s not the point. The case is too close to the personal finances of the president who appointed her. That doesn’t work for any judge.
As then attorney Rao and I used to tell the White House staff when we worked together in the White House Counsel’s Office, some things are legally permissible but just look awful....
Executive power cases involving a president who appointed a judge are one thing. Recusal is not expected.
But a case involving the President’s personal finances? That’s a bridge too far if a judge wants to avoid the appearance of giving a financial benefit after being appointed
