2/ And it has come to this. A court is being asked to issue a gag order against the President of the United States, and to order an executive branch agency to "counteract" the President's statements.
3/ The judge shied away from the notion that he could enjoin the President from tweeting, but said that it could be possible to order the President's subordinates to "take whatever steps are necessary to counteract" the President's tweets.
4/ Last July when I argued the 3D-printed gun case, the District Court Judge asked about the President's tweets that were inconsistent with DOJ's stated position. These tweets really put government lawyers in a bind. The solitary executive redux: lawfareblog.com/solitary-execu…
5/ One day, I will write a book chapter about this colloquy: could a district court issue an injunction to require principal officers to publicly denounce their commander-in-chief's tweets.
6/ Proposed court order, based on DOJ's argument: "We need a total and complete shutdown on contradictory tweets exiting the President's phone until we can figure out what is going on."
