(If you follow me regularly you may remember I have tweeted a number of times about the dangers of the Civil Contingencies Act 2004. Yep, they're real.)
But it's also possible that this is a further ramping up of the Government's desperate attempts to precipitate a VONC and therefore a General Election. In a GE situation, Parliament would be (legitimately) dissolved 25 working days in advance of the poll. No more stopping Brexit.
NOTE: I am aware some superb legal minds think it won't work.

I am *not* disputing their expertise or their conclusions.

I am merely pointing out respectfully that the law doesn't always produce the right outcome *quick enough*. There is a firm, fast deadline involved.

Biggest disconnect for those on the Leave side: they value our EU membership at £0.

That's why for them "arguments" like "other countries survive fine outside the EU" seem to make sense: because they don't acknowledge the £100s of billions of trade we already do as EU members.
It's like saying "if we change our shoes, we can run this marathon faster" without accounting for the fact that our spare pair is back at the start line and we're 25 miles in.
Once you realise that, it's like a lightbulb going on. For some, it literally doesn't matter what you say about our EU membership because it will always have a "worthless" next to it in their minds.

(I don't know how one solves it, but I believe it's a genuine and real problem.)

Wow! Looks like there's a hole in the Benn Act. It's not so much a hole in the act (as I understand it) as a hole in the whole system. It's another of those "it's always worked for 350+ years because people followed conventions" situations, I think.
Now, just like every other dirty trick, it can be stopped by legal means. But as I indicated in the other recent thread (about the Civil Contingencies Act) the problem with that is the courts don't *always* move at the speed necessary to squash a fast-moving situation.
This is what happens when you flip the conversation from "what are we allowed to do?" to "what can we do?" When you throw anything and everything against the wall to see what sticks. When you care not one jot about convention or precedent or history or preserving our system.

Four mechanisms raised so far: 1. Major said PM might make an Order of Council to postpone the coming into force of the Benn Act so as to render it nugatory 2. Grieve suggested they may be whipping up unrest in order to declare state of emergency under Civil Contingencies Act 2/8
3. others have suggested two letters may be sent - one requesting an extension and another retracting the request. 4. Finally, a head of state (Orban/Salvini) may be persuaded to refuse an extension; unanimity being required for it to be granted. 3/8

As far as I can make out, we have now heard of 5 suggested routes around the Benn Act, the legislation which would compel the PM to seek a delay of Brexit until next year if Parliament had not approved a deal or no deal by 19 October. All, I think, are dead ends.
Route 1 (ht @owenjbennett): send letter requesting extension as required, but also an "explainer" which says that he doesn't really want one. Dead end because unlawful: the Act says he must "seek to obtain" an extension, and he wouldn't be doing so.

Route 2 (ht @JolyonMaugham): Get MPs to vote for a deal - so the duty to seek an extension falls away - but don't get them to vote for legislation to implement the deal. Under the EU (Withdrawal) Act 2018, that means HMG can't ratify. Hence no deal.

I expect to be on @BBCr4today at 7.10 am commenting on this suggestion that the Government may attempt to use an Order of Council to suspend the Benn-Burt Act that requires the PM to seek an Article 50 extension. /1
My view is that while a Government attempt to do this may cause delay (because of the need for judicial review) there is no sound legal basis for what appears to be proposed. /2
It is unclear from Sir John Major's speech exactly what may be in contemplation. One possibility would be an Order made under the royal prerogative. But that would plainly be incapable of suspending an Act of Parliament. /3

So under the Civil Contingencies Act 2004, where there's an emergency, and various other preconditions are satisfied, regulations can be made by Her Majesty by an Order in Council.
And those regulations would in principle enable legislation, including the Benn Act, to be suspended.
Of course, there isn't an emergency, and those other preconditions aren't satisfied, and so there can't lawfully be a suspension of the Benn Act. But who cares right, because a lawful suspension isn't the strategy?

But, in general terms, cannot see how using such an Order to frustrate the Benn Act would survive a JR challenge on "Padfield" grounds

On 10/31/17, a terrorist from Uzbekistan (Khazakstan) killed 8 and injured 11 only 5 blocks from the new WTC. So if he died too, that’s 9 dead, 11 injured. In the biggest attack on NYC since 9/11.
