The two main types of defamation are libel and slander. There are notable differences between these two. Written defamation is called "libel," while spoken defamation is called "slander."
A defamatory statement is a false statement that exposes a person to hatred, ridicule, or contempt, causes him to be shunned, or injures him in his business. Statements that are merely offensive are not defamatory. E.g. Saying someone is stupid.
Generally speaking, Defamation is not considered a crime, it is rather considered a "tort" (a civil wrong). A person who believes he has been defamed can sue the person who did the defaming for damages. However, this defers from country to country.
Generally speaking, If you believe you are have been "defamed," to prove it you usually have to show that there is a statement that features ALL the following:
- Published
- False
- Injurious
- Unprivileged
