So Judge Howell DENIED DOJ’s motion for a stay (delay) in DOJ’s obligation to turn over the unredacted Mueller report and grand jury materials to Congress. Here’s a (lengthy but important) passage from her ruling: “the public interest also weigh(s) against granting DOJ’s motion.
An impeachment investigation involving the President of the United States is a matter of the most critical moment to the Nation. As the DOJ has acknowledged, the Framers themselves specifically determined by providing for an impeachment process that
there is a public interest in immediately removing a sitting president whose continuation in office poses a threat to the Nation’s welfare. Both HJC itself and the public, therefore, have an interest in HJC gaining immediate access to this grand jury materials.”
However, the appellate court (the DC Federal Circuit Court) issued an administrative stay. But it’s unclear if that was before or after Judge Howell’s order denying DOJ’s request for the stay. That should get sorted out today. But the Nation thanks Chief Judge Howell for
recognizing the “public interest in immediately removing a sitting president whose continuation in office poses a threat to the a Nation’s welfare.” The State our our judiciary remains strong (notwithstanding Mitch McConnell’s efforts to weaken it).
