1-Here's a fun story about how the major victory in USMCA got lost in the omnibus. (This is the tip of the iceberg compared to what I'm hearing, this one happens to have been discovered and is public.)
2-so the big win in USMCA was eliminating the pharma provision. This would have done two things: a) locked in a 10-year exclusivity period for high-cost biologic drugs, b) expanded the definition of what a biologic is.
3-In the US we already have a 12-year exclusivity for biologics. The reason to kill the 10-year was that if it got into a trade deal, it would be extremely hard to lower the exclusivity below that number without committing a trade violation.
4-Still, we already have the 12-year. So the only tangible, immediate victory from removing the pharma piece from USMCA is not expanding the definition of biologics. Funny story...
5-Here's page 1,503 of the omnibus. 
6-This is PRECISELY what was taken out of USMCA, now put into the omnibus, and soon to become law.
7-Now the FDA is saying this is how they always interpreted biologics anyway. (The FDA said something different earlier in the year however) But Congress does get to make laws, and could set that definition any way they want. They chose the most expansive one.
8-This is a pure giveaway to drug companies that undermines months of work on trade. And House Dems just handed it over.
