Supreme Court bench led by J AM Khanwilkar begins hearing plea seeking cancellation of #CBSE exams due to #COVID19

Adv Rishi Malhotra for petitioner: Maharashtra, Delhi and Odisha have indicated their ability to conduct CBSE exams this year.

SG: Our affidavit filed half an hour back states that taking into account suggestion from States, exam for Class 10 and 12 from July 1 stands cancelled.

SG: Cbse has scheme in which marks scored in past 3 exams will be taken in account.

For class 12, exams will be conducted "as soon as situation is conducive." "Marks for students who opt for class 12 exams will have that marks as final."

SG: However, those who do not opt for exams, will have their past exams make up for their performance and assessment accordingly.

CBSE Class 12 exams is thus optional.

SG: We took this decision due to logistic issues. Many schools are quarantine centres. Parents are also worried. Thus the mental equilibrium stands affected

SG: For class 10, there is no option for exams. The CBSE board exam for class 10 stands cancelled.

J Sanjiv Khanna: You need to make some changes in the reply. The language needs to be improvised.

J Khanwilkar: There should be no confusion

J Khanwilkar: If you see the dates, you will hold exams for Class 12 sometime. So dates for other exams need to be postponed.

SG: Admissions now will be only on the basis of the assessment. They can apply on the basis of assessment.

J Khanwilkar: there needs to be clarity

SG: The result on the basis of the assessment for the basis of both Class 10 and 12 will be published by July 15.

J Khanwilkar: Then academic session needs to begin from September

Adv Malhotra: So far as assessment is concerned, in CBSE, all papers have practical and theory component. Practicalsare over. Theory is left. They can take average of practical and grant total marks.

J Khanwilkar: we cannot direct CBSE these nuances. It's for them to take

SG: We will notify the new system in place. Experts are there who will look at it.

J Khanwilkar (to petitioner): Let the authorities do their job.

Adv Malhotra: Let CBSE declare assessment results by the end of the month. There are entrance exams also for students.

J Khanwilkar: Indicate in notification itself that when will results be announced and timeline

SG: Notification will be latest by tomorrow

Adv Sandeep Jindal: Several competitive exams are lined up. Situation in Delhi is not very good.

J Khanwilkar: SG will look into this

Adv Jindal: But there is urgency. IIM Rohtak on June 28 will conduct their entrance. These need to be postponed.

J Khanwilkar: Let the aggrieved persons of this course come before us. CBSE is here.

Adv Jindal: Please de tag by petition and take it separately.

J Khanwilkar: We cannot run educational institutions from here. Our orders will have cascading effect on others. Issue is board exams and we are not going into anything else.

SG: Please grant me the permission to change language of the affidavit.

J Khanwilkar: We will say that the draft notification is before us. You will keep the essence same and file a fresh one giving more clarity and details about the process.

ICSE hearing begins

Senior Adv Jaideep Gupta: We are in principle agreeable to the CBSE proposition. We will also cancel the Class 10 and Class 12 exams. We will declare the assessment results at once. Later, we may hold the board exams.

Senior Adv Gupta: We will follow the exact pattern like CBSE as far as exams and assessment is concerned. Later we will decide whether to hold the board exams or not.

J Khanwilkar: You have mentioned exams will be conducted when situation is conducive. But this can vary from state to state. Will this decision be taken by Centre or the state? Like in Maharashtra, they are not able to conduct it or not.

SG: Centre will deal with it at the central level when it is conducive in all the states. However the vagueness is in the subject itself.

J Khanna: CBSE has different regional boards now.

SG: No there is only one.

J Khanwilkar: Let us pass formal orders tomorrow. You can file a fresh notification too and clear instructions that a final decision of a later exam will be taken at the central level and not at state level. This will have repercussions on other exams.

SG: for that students will have to submit their assessment marks.
