So @pippa_hackett announced late Friday of the Aug Bank Hol, as the Dail arose for summer recess... a very short consultation (28 days) over the peak summer hols.. so many will miss it. .. So this was me 🤔 as I always worry when someone burys a consultation with its timing & ...
this one isn't even published on the Agri Dept's main web page so out with the old 🧐 to see what's up ? In short the bill proposes to : .. wait for it ..its bad ..
It:
😟Limits who is entitled to appeal, and
😠Gives the Minister powers to:
oIntroduce fees for making an appeal on forestry
oSpecify a whole range of additional criteria to qualify as an environmental group, potentially impacting local & national groups appeal rights,and..
- it proposes structural changes to how the Forestry Appeals Committee operates, & gives the Minister powers to give it directions, raising concerns over its independence and impartiality in deciding on appeals on the Minister’s decisions.
The recommendations of the controversial Mackinnon report are the basis for the changes proposed, but the proposals we see in this bill are just the tip of the iceberg of Mackinnon’s deeply problematic recommendations for #Forestry. Discerning eyes see clearly the rpt proposes:
-that Ireland should engage with the EU Commission to allow the Minister permit forestry decisions even where they have adverse impacts on our most sensitive & important #Natura2000 habitats & species, & try to argue this now meets a special legal test in the #HabitatsDirective..
in Article 6(4) namely "imperative reasons of overriding public interest" (IROPI) on the basis its justified for #climatechange. So our failure to adapt & to address climate action is to be compounded & offset by thrashing our most important sites for #biodiversity
That’s a clear part of the Mackinnon agenda on top of fees for appeals which this new bill proposes & also possible fees 4 observation on forestry applications later. The Greens signed up to this in the Pgm for Gov & the rpt is being championed by Green Minister Pippa Hackett. So
- to put it mildly a strong push back is needed now to halt the Mackinnon momentum. But there's more ..😔
A core concern also is that Minister Hackett’s 1st legislative move is to address her concern about the delays to forestry from appeals by curtailing people’s right to appeal decisions, instead of fixing the problems with quality of her decisions, so there is no need to appeal!
The Minister is also failing to prioritise & focus on:
👉delivering on a reformed forestry pgm & grants,
👉sorting out the problems with the legislation, data & the decision-making system
- to deliver #Reformforestry meaningfully for: climate, nature, communities, industry
So pls joint the call to #DitchPippaHackett's bill & #DitchMacKinnonRpt Lets together avoid the inevitable unproductive quagmire that would mean for us all for Minister #PippaHackett, her officials, the Oireachtas ..instead in your subs to ForestryBill2020@agriculture.gov.ie
Call for the Minisiter to
📜"Prioritise the priorities"The current forestry pgm is effectively expired, so the Minister needs to urgently prioritise focus on a new pgm & approach for forestry which is appropriate, acceptable & feasible, which can be delivered in compliance with
#EnvironmentalLaw which protects the #environment & hence the wider #publicinterest

💰"Glam up the grants" revisit & revitalise the grant system so it incentivises delivery of the types of forestry we want in this new pgm = #theRightTreesInTheRightPlaces = real benefits for all
🛠️ "Fix the problems at source" The Minister must focus on improving the quality of decisions. So long as decisions are flawed delays & uncertainties will arise, appeals will be inevitable & forestry will struggle. Restricting rights will only compound delays with legal issues👩‍⚖️
So sort out issues with forestry legislation, data inputs, expertise & resourcing, and improve the quality of decisions so appeals are fewer & simpler.
💚 Cherish appeals as they stop bad decisions hitting the ground which Minister Pippa Hackett will be responsible for and for which Ireland & we taxpayers will then have to pay to remediate and sort complex resolutions and where the environment suffers in the meantime ...
🗑️💣 "Ditch Mackinnon" - it's not fit for purpose & is starting from the wrong focus
"Withdraw the consultation". It is badly timed, poorly publicised even on the Dept's website, is not supporter with consolidated legislation so people can understand the effects of the changes proposed, & is unsupported by data and evidence to justify these changes...
