The reply alleges an insidious propaganda by political parties, a section of media to malign the Yogi Govt despite a "diligent probe".
This affidavit claims political parties, a section of media is trying to give a communal & casteist colour to #Hathras incident & hence, the #SupremeCourt should monitor the #CBI probe in a time bound manner. This will ensure a free probe besides weeding out false narratives.
About the midnight cremation of the #Hathras victim, UP Govt says she was cremated in the presence of her family members, who agreed to attend in order to prevent further violence. Affidavit adds it was done to maintain law & order.

#Hathras hearing begins with SG Tushar Mehta appearing for the state of #UttarPradesh.
He says unfortunate death of a young girl shouldn't be sensationalised.
"There are narratives and narratives that may impede a fair probe. Let this court monitor the probe."
Sr adv Indira Jaising also appears in the matter, asks for security of the victim's family. She seeks fast-track trial in Delhi.
#CJI: We are not saying what has happened isn't shocking or that it isn't unfortunate. We are currently examining the petition as has been filed here.
SG Mehta: The family has already been given police protection.
Jaising reiterates justice can be done only by transferring the trial to #Delhi. She adds a judicial inquiry, under the supervision of a former judge is preferable.
#CJI: We are hearing you because the incident is shocking and extraordinary. We are also appreciating your assistance but you may not have the locus. Let us hear the petitioners also.
Jaising: Technically, even the petitioners may not have the locus.
Petitioner's lawyer: We are shocked at the incident.
#CJI: Everyone is shocked, that's okay but when a court asks you why are you here, you have to give different reasons...we understand your anxiety but it will be in your best interest if you keep quiet for a while.
#CJI Bobde now asks why the #Hathras case can't be heard by the Allahabad High Court at first instance.
"Everything being argued here can be taken care of by the High Court. We may also get the benefit of the High Court order first. Isn't that a better course?"
SG Mehta: Outside courts, several narratives are being weaved. All this can be stopped by a monitoring and investigation by a central agency.
"Things are being argued here without knowing the facts. Witnesses are being protected."
"There are reporters recorded as instigating family," says Mehta, adding if lawyers are to be appointed as amicus, it should be a choice of this court and not some lawyers.
As a lawyer interrupts the #CJI, he gets agitated: "I believe we at least have a right to complete our sentence. Do we need your permission to do it? Lawyers can keep interrupting each other but we don't like being interrupted in the same way."

3) What's the scope of High Court proceedings and how we can widen its scope
SC adds it will ensure the investigations is smooth.
Notices issued, hearing adjourned to next week for the state to file another affidavit on the three aspects.

#Delhi High Court is hearing a petition by actor #RakulPreetSingh against tirade of charges against & 'fake news' against her.
Her lawyer submits she was called as a witness by #NCB & didn't implicate anyone.
"I am a non-smoker, a teetotaller, never did drugs. I have been replaced in a short film because of all this. My reputation is in tatters. All news channels are airing unsubstantiated charges": #RakulPreetSingh to High Court.
ASG Chetan Sharma, for Govt, says she is not an accused as on date & he sympathises with her. "But any observations by this court at this juncture may have a ripple effect. This is a sensitive case."
But HC tells him there has to be some balance, I&B should question channels.
Solicitor General Tushar Mehta informs the bench that the channel has now been issued a show vase notice under the Cable TV Act.
SG suggests #SupremeCourt may defer these proceedings till the Ministry of Information & Broadcasting takes a final decision on the show cause notice to #SudarshanTV.

Sr adv Harish Salve begins arguing for the petitioners.
The bench seeks to know where is the threat issued by the #Delhi Assembly Peace & Harmony Committee.
Salve takes the bench to the relevant page in the petition.
"This is quite remarkable. Who is this deputy secretary issuing this serious threat. What privilege, whose privilege?" Salve submits before the bench headed by Justice Sanjay K Kaul.

#SudarshanNews matter commences in #SupremeCourt with sr Adv Mukul Rohatgi mentioning he is appearing for NBF (National Broadcasters' Federation).
Rohatgi informs NBF is the largest body of channels in India, having majority of regional channels as its members. He adds NBF wants to put its views forth on regulations relating to TV channels. Former CJI KS Khehar has agreed to be a part of the NBF's self-regulatory body.
The application contends #SupremeCourt doesn't have jurisdiction to frame guidelines. He adds there are over 1000 reports how media has been reporting about religious issues.
