Supreme Court to hear a challenge by Maharashtra govt to the Bombay HC order whereby it had suspended two FIRs filed against Arnab Goswami over statements made against Sonia Gandhi and ‘communalising‘ a gathering of migrant workers in Mumbai’s Bandra
The Bombay high court bench, comprising Justices Ujjal Bhuyan and Riyaz I. Chagla had observed: “We cannot have the spectacle of a Damocles’ sword hanging over the head of a journalist while conducting a public debate.”
Singhvi: The High Court has stayed and suspended the FIRs while admitting the matter. It says you (Police) cannot investigate the matter. How can the investigation be stayed?
CJI Bobde: Police can ask questions, even the statute says that and we don't think that the Courts should interfere in that but it has to be done in a certain manner.
Singhvi: I would request Your Lordships to pass an order allowing the investigation without coercive steps.

Singhvi: Investigation may go on and we will do:
- We will not arrest
- We will issue summons
CJI: 48 hours before...
Singhvi: Your Lordship should also see that a message does not go out that some people are above the law
CJI Bobde: While nobody is above the law, some people are targeted with higher intensity. There is a culture these days, that some people need a higher degree of protection.
Senior Advocate Harish Salve for Arnab Goswami tells the Court of the series of events since April 2020 when the FIR was filed.
Salve: As on date, there is an FIR filed against the entire editorial team of Republic TV.
Salve: Various people from the Channel and management have been questioned for long hours.
CJI Bobde: It is possible that even after a long period of investigation, suddenly a question may occur to the Police which is crucial and needs to be asked.
CJI Bobde: Keeping your client aside... we agree with #FreedomOfPress but we don't appreciate the submission that as a person from the media your client should not be asked any question.

CJI Bobde: The point is this that we would like you (Salve) to put on affidavit and give a picture of course of things to come. Everyday we are getting something.
Supreme Court to hear the matter next after two weeks by which time #ArnabGoswami (and #RepublicTV) as well as State of Maharashtra to file their respective affidavits detailing all cases the Anchor and the channel are sought to be prosecuted in.
A three-judge bench of Chief Justice SA Bobde and Justices DY Chandrachud and L. Nageswara Rao
will shortly hear a suo motu case regarding courts functioning via virtual mode during the #COVID19 pandemic.
The top court had taken suo motu cognizance of a letter written by senior advocate and former Supreme Court Bar Association (SCBA) president Vikas Singh, who has suggested measures for use of technology for conducting hearings in the courts.
SC observing “technology is here to stay”, had passed directions by exercising its plenary power under Article 142 of the Constitution & said that all the measures which shall be taken by the courts to reduce physical presence of stakeholders within its premises “will be lawful
CJI: Welcome step, this is something that government should have acted on. This is not a matter for PIL... The only issue is people are choking because of pollution and it is something which must be curbed.
SG Mehta: The petitioner is a lawyer and not a lay person. Please look at para 6 of the additional affidavit. This is unpardonable even for a lay person. This is seriously objectionable.
CJI: Mr Petitioner, you are an advocate no ? First of all keep quiet and don't think you are greater than everyone else. We don't think you should write such things about any adv forget him being senior.

SC: You should have been more proactive. HC would not have interfered if you would have monitored the situation well

SC: your role as Election commission is wider. You should have informed the authorities well. Public meetings need not be regulated but seen that the protocols are followed
CJI SA Bobde led bench to hear plea seeking a court-monitored CBI probe into the death of celebrity manager Disha Salian who died a few days before actor Sushant Singh Rajput's death.
