CJI NV Ramana led bench of the #SupremeCourt to hear a batch of petitions seeking #RathYatra to be allowed all cross Odisha and not only the Puri Jagannath temple as permitted by State Govt and upheld by Orissa High Court
Apart from the lead plea by Odisha Vikash Parishad (the same petitioner who moved #supremecourt last year seeking a stay on the Rath Yatra organsied), a number of appeals are listed against the Orissa HC judgment which allowed the #rathyatra to be confined to only Puri temple
Read about one such plea seeking the rath yatra to be conducted at other sites apart from Puri #supremecourt#Rathyatra
Another application by Bhanja Sena states that if first Shrikshetra Puri temple is allowed to observe #RathYatra then not allowing the Dwitiya Shrikshetra, Baripada Lord Jagannath temple "is a clear case of discrimination and as such violative of Article 14 read with Article 25"
SG Tushar Mehta: this may have some significance. Let me take instructions. #supremecourt
CJI NV Ramana: all of you want publicity (to all the appellants challenging the Orissa High Court verdict)
CJI: Who filed the writ petition? Adv Ranjeeta Rohatgi?
Adv AK Srivastava: we are considered to the second puri (BARIPADA) in the state and its in 445 years first time that we are being denied rath yatra. We are preparing in accordance with COVID19 guidelines
CJI: you want the rath yatra in your place? okay, you stop there.
CJI calls for Orissa Vikash Parishad
AG for Orissa, Ashok Parija: the Parishad is not seeking any relief
Intervenor PK Mohapatra: we have no interest in the matter any more.
Adv Manjunath Meled: we want the rath yatra to be conducted at Nilgiri and Sasang temple too in accordance with directions imposed upon Puri temple
Adv Abhigya Kaushik appears for the yatra to be conducted at Baripad like the one allowed to be conducted in Puri Jagannath temple
CJI: I want to know the locus of all these applicants. There are 20 applications filed
Adv Rohatgi: this writ by Odisha Vikas Parishad is of last year and has worked out. No applications under this may not be entertained
Rohatgi: Under item 5 Madan Patri case new pleas have been filed and may be considered accordingly. #supremecourt
Adv Jitendra Mohapatra: last year puri rath yatra took place, again state this year said due to covid it will not be allowed but high court said it will be allowed only in puri jagannath temple.
CJI: don't waste your time, read order passed by state govt
Mohapatra: HC said since SC last time did not allow the procession last year they wont this time. But SC did not say that
CJI: last year so many people did not die, this time a lot of people died.
SG Tushar Mehta: last year there was a complete prohibition of rath yatra and it was permitted with some restrictions on June 22, 2020. now state of Orissa has allowed yatra only in Puri. But there are other places in state where yatra is going on since centuries
SG: A token symbolic yatra can be allowed to be permitted with no gathering of public so that religious sentiments are protected and also the health of people amid the covid19 pandemic #supremcourt
AG Ashok Parija: there are no questions of faith of people being affected. Last year puri was under curfew. chariot must be pulled for 500 people who have rt pcr test and all entry points be closed. The state has number of yatras, how will the state ensure all these conditions
AG Parija: how can we impose the conditions which you imposed last year all across the state. it is not possible. Puri is different than others and hence separate arrangements. #supremecourt
CJI: I also go to puri every year but haven't gone since the last 1.5 years. I do puja at home. If you want to go to Haridwar, you can pray at home too. Govt has taken a considered decision. #supremecourt#rathyatra
CJI: you and I are not the people who can predict the covid19 situation. don't poke your knowledge into this matter. Let the government decide.
CJI: Thank you we watch it in television only
Adv, Mohapatra: the baripada yatra is a day after puri yatra
CJI: I also feel bad but we cannot do anything. We hope and trust god will allow next rath yatra atleast
