Today at 10AM, the Texas House is meeting for the 1st time in 2 special sessions to consider bills on 2nd reading. At the top of the agenda is the elections bill #SB1. In cmte, they subbed it out w/the text of the House ver. (#HB3). We'll be live-tweeting the debate. #txlege
Here's the text of the House Cmte Substitute of #SB1 (nearly identical to the filed ver. of #HB3 in the first special that led to the House Dems quorum break): capitol.texas.gov/tlodocs/872/bi…
#txlege
Phelan just gaveled in. We'll let y'all know when the debate on the elections bill #SB1 begins. #txlege
109 votes in the first record vote for the Texas House. So we are well above the 99 needed to maintain quorum. #txlege
Speaker Phelan asks members for respect and civility for today's debate. #txlege
.@MorganMeyerTX moves to postpone #SJR2 to 3pm so that elections bill #SB1 can be considered first. @ChrisGTurner objects, request for record vote. Motion to postpone prevails, 83-26. #txlege
Debate on #SB1 has started. Murr opens. Watch live here: tlchouse.granicus.com/MediaPlayer.ph… #txlege
Murr starts with a history lesson on elections where Texas led other states and has continued to update their laws and procedures. He notes that current version of #SB1 has language proposed by both Dems and Rs, which is true. #txlege
Murr says he has considered both parties' and the public's input in his pre-filed amendment. Here's the text: capitol.texas.gov/tlodocs/872/am…

We'll highlight some of the changes in the following tweets. #SB1 #txlege
- Removed warning req. b4 an election judge who observed a poll watcher violating Elections/Penal Code can remove them. Some say this gave a free pass for voter intimidation. Now, poll watcher can be removed if an election judge or clerk observes them violating the election code.
more in #SB1 Amndmt 1:
- Increases penalty for election officer excluding a poll watcher from a Class B to Class A misdemeanor
- Adds election ID certificate as an option for an ID number for mail ballot apps.
- Allows for mismatch of ID # on mail ballot apps to be cured
#txlege
More on Amendment 1 when it comes to the floor. #SB1 #txlege
.@MattShaheen is on the back mic asking if Murr intends to disenfranchise voters of color like the House Rs of color (names himself, Lozano, Jetton & White) w/#SB1. Murr says no. Also asks if police can be called if there's a disruption by a poll watcher. He says yes. #txlege.
Shaheen also points to an oath to not disrupt the election process. Murr also says that affidavits for when a voter ID is not used will apply to #SB1 provision requiring D/L # or SSN for mail ballot apps. #txlege
Murr says his amndmnt adds a cure for the mismatch of an ID # on a mail ballot, similar to the Senate engrossed version. Shaheen took the entirety of the time for a bill layout. Turner moves to extend time. Granted it appears. #SB1 #txlege
Phelan asks members to refrain from using the word "racism" in today's discussion. #SB1 #txlege
Turner asks how many instances of fraud in 2020.

Murr says the bill is forward-looking. He also agrees w/Turner that the 2020 election was safe and secure. #SB1 #txlege
Turner asks if Murr met with Paxton or his staff about voter fraud investigations. He says no. Turner asks if Murr is familiar with the info raised in @HoustonChron story: houstonchronicle.com/politics/texas…. Murr doesn't disagree. #SB1 #txlege
Turner asks if Murr did a racial impact analysis for #SB1.

Murr says no. Turner asks why?

Murr says he doesn't know if a study is required and isn't aware of any racial impact studies on the bill. #txlege
Turner asks where the regular session #SB7 CCR provisions targeting souls to the polls and making it easier to overturning the election came from.

Murr says he does not know. He also says he doesn't want those provisions in this bill. (cc: @Vasut). #SB1 #txlege
Bucy on the back mic. He tries to make the point that prohibiting 24-hr voting is a reduction in early voting hours possible in TX. Murr only agrees that there wasn't a prohibition before, but notes Harris Co. was alone in implementing 24 hr voting. #SB1 #txlege
Dutton on the back mic thanks Murr for meeting w/him on #SB1. He asks why increasing & encouraging voter turnout isn't the purpose. Murr says just b/c people have the right to vote doesn't mean they can force folks to vote. He says it's an individual responsibility. #txlege
Time has been extended. Rep. Yvonne Davis asks if it's Murr's intent to usurp local election administrators for what hours should be in their counties.

Murr says #SB1 builds on current law which prescribes minimum hours. The bill gives a start time & an end time. #txlege
.@RepWalle asks about #SB1 provisions (sec. 3.11 & 3.12) aiming to prohibit drive-thru voting as it happened in Harris Co. in the 2020 election available to all voters, not just those eligible for curbside voting. Murr says this addresses issue of voter privacy. #txlege ImageImage
Walle now asks about the provision creating a new state jail felony offense for an unsolicited distribution of mail ballot applications by the public official. Murr says his perfecting amendment would make sure this only applied to election officials. #SB1 #txlege
Murr points to cmte testimony which raised concern if a potential voter is not aware of the mail ballot app heading their way, you have the likelihood of fraud. He said the policy goal is this is a passive system.

Walle asks Murr to clarify where's the likelihood. #SB1 #txlege
Murr doesn't give a clear answer.

@RafaelAnchia up now. He points to @LongoriaTx cmte testimony that 57% of drive-thru voting was used by ppl of color. Why does this increase likelihood of vote?

Murr goes to privacy issue of being in a car w/other people when voting. #txlege
Anchia asks if there was any voter who complained of secrecy infringed when using drive-thru voting.

Murr: I'm not advised.

#SB1 #txlege
Murr says another policy goal is uniformity which is another reason to prohibit drive-thru voting (as Harris Co. was the only county in 2020 to do this pandemic innovation). #SB1 #txlege
Anchia asks how banning drive-thru voting during a pandemic furthers any of the goals (secrecy, reducing likelihood of fraud, or access to the ballot)?

Murr says he heard testimony of 3rd parties suggesting there could be secrecy issues but none from voters who used it. #txlege
That's the end of the bill layout. We're onto amendments now.

@Jon_RosenthalTX moves that all questions and answers on the layout of the bill get recorded and put into writing in the journal. #txlege #SB1
Braddock reports there are ~70 filed amendments so far. #SB1 #txlege
Correction for earlier in thread: Murr's prefiled amendment is not Amndmnt 1 on #SB1. That goes to Anchia. It would strike the enacting clause effectively killing the bill. It allows him to talk against the bill & how it's based on The Big Lie. capitol.texas.gov/tlodocs/872/am… #txlege
Anchia defends Dems going to DC. Points to how the times TX expanded the franchise, Ds were in control. Anchia points to time during GOP control of the state in the last decade, federal judges have found TX voting laws to have discriminatory effect multiple times. #txlege
Murr opposes Anchia's amendment. @GeneforTexas is on the back mic asking Qs on the bill, which is in order b/c the amendment concerns the entire bill. #SB1 #txlege
.@RepJMLozano speaking against the amendment. Said there have been instances of voter fraud contrary to what Anchia said. Points to Dem Steve Wolens who he says isn't racist when he drafted the last big election reform in '03 (HB 54) reforming vote by mail system. #txlege
Anchia is on the back mic. He questions Lozano's characterizations that Anchia cared less about voting rights because he broke quorum and left the state. This got personal.

Phelan reminds members to stick to the bill. #SB1 #txlege
Amendment 2 is the one prefiled by Murr yesterday. Here's the text again: capitol.texas.gov/tlodocs/872/am… #txlege
More things we haven't covered yet in Amndmnt 2:

- Mandatory notice by early voting ballot board & signature verification cmte if they find a defect that the voter can fix for their VBM app.

- strikes physical disability reference in assistor oath. #SB1 #txlege
Amendment 2 also incorporates Sen. @JudithZaffirini's amendment for the @TXsecofstate to study & implement disability voter education on how to use voting systems in the state. #SB1 #txlege
Chris Turner is asking about a cure provision in the amendment that doesn't mandate but gives discretion to a signature verification cmte to notify mail voters that there was a defect w/their ballot or the signature cannot be verified that they could cure it. #SB1 #txlege
Murr's amendment 3, which is an amendment to amendment 2, just has correcting language. Adopted. #txlege
Amendment 4, by Cain, which is an amendment to amendment 2, defines what an election official is in code. #SB1 #txlege capitol.texas.gov/tlodocs/872/am…
.@TurnerForTX moves to have all discussion on amendments and #SB1 reduced to writing and placed into the journal. #txlege
Amendment 5, which amends Amendment 2, by @SherylCole1 amends the intent language of #SB1 to what she claims will make sure the most people who are legally able to vote can vote. Murr opposes. Amendment fails 36-80. #txlege Image
Amendment 6, which amends Amendment 2, by Rep. Cook reverses one of the changes in Murr's amendment. He approves of it. That's surprising as he defended this change in his amendment layout. The amendment to the amendment is adopted. #SB1 #txlege Image
Amendment 7, which amends Amendment 2, lowers the penalty for election officers excluding a poll watcher from a Class A to a Class C misdemeanor. Murr opposes because he says there should be uniformity in penalties in the code. It fails 38-80. #SB1 #txlege
capitol.texas.gov/tlodocs/872/am…
Murr closes on his lengthy amendment. Amendment 2 as amended is adopted without objection. #SB1 #txlege
Dutton laying out Amndmnt 8 includes "increase voter turnout" as part of the objective/intent of the bill & the Election Code broadly. He doesn't mention it but it also admits the rarity of voter fraud in the legislative finding, which likely is a tough sell for Rs. #SB1 #txlege Image
Murr opposes Dutton's amendment and says the state's goal should not be to seek out voter turnout. It's down to personal responsibility and choice of each voter. #SB1 #txlege
Zwiener pushes Murr on this policy goal. He says there are opportunities to inform ppl of their rights both in civic ed for students. As for adults, it's up to campaigns & elected officials to turn them out. We don't need encouragement to vote in the intent of #SB1. #txlege
Dutton says he doesn't think anyone in the House would disagree w/wanting to increase voter turnout. He says without this addition (in his amendment), the other objectives aren't meaningful if fewer people turnout. #SB1 #txlege
Dutton: "If we can't get together on voter participation, then God help us."

Murr leaves it to the will of the house. Amendment 8 fails 41-80. #txlege
Cole's amendment fails. #SB1 #txlege Image
Amendment 10 by White is withdrawn after a point of order was raised. #SB1 #txlege Image
Amendment 11 by Bucy makes sure no reasonable accommodation that a person w/a disability is entitled to under state/fed law will be prohibited by any interpretation of the election ocde. #SB1 #txlege
capitol.texas.gov/tlodocs/872/am… Image
Schofield is on the back mic raising concern on Bucy's amndmnt that this reasonable accommodation provision for the disability community doesn't get abused. Bucy disagrees that it has been getting abused & said we should trust the disability community won't abuse it. #SB1 #txlege
Murr speaks on the Bucy amendment to protect rights of voters w/disabilities. Says he leaves it to the will of the House. It passes 72-47. #SB1 #txlege
Amendment 12 by @BryanforHD2 would appoint a third party to conduct a Forensic Audit of the 2020 election of counties w/population of 415K or more. @TurnerForTX brings a point of order that the amendment is not germane to the bill. #SB1 #txlege Image
While we wait for the point of order to get resolved on Slaton's forensic audit of the 2020 election, here's the vote breakdown of the Bucy disability right to vote amendment. #SB1 #txlege
Slaton amendment and point of order are both withdrawn. #SB1 #txlege
Amendment 13 by @RepToniRoseTX would have the @TXsecofstate study changes to the Election Code each biennium & its impact on different racial and ethnic groups. The report would be given to #txlege by Jan. 31 of odd-numbered years. #SB1 Image
Murr opposes this amndmnt saying this topic has been brought up multiple times during cmte. Rose pleads to the body to consider communities that aren't their own. Amdnmnt for biennial racial impact studies on election code changes fails 41-78. #SB1 #txlege
Amendment 14 by @moralesfortexas would allow one election officer at each polling place deputized as a voter registrar & allow for same-day voter registration. He claims 37 other states have registration sooner than Texas. #SB1 #txlege capitol.texas.gov/tlodocs/872/am…
Murr opposes Amendment 14. It fails 42-78. #SB1 #txlege
Cain Amendment 15 is withdrawn. #SB1 #txlege
capitol.texas.gov/tlodocs/872/am… Image
Morales Amendment 16 to have automatic voter registration through @TxDPS fails 38-81. #SB1 #txlege
capitol.texas.gov/tlodocs/872/am…
Bucy Amendment 17 to allow for universal online voter registration fails 42-79. #SB1 #txlege
capitol.texas.gov/tlodocs/872/am…
Howard Amendment 18 to provide high schools with voter registration apps fails 43-78. #SB1 #txlege Image
Goodwin Amendment 19 related to military and overseas voters fails 40-81. #SB1 #txlege capitol.texas.gov/tlodocs/872/am…
Amendment 20 by Slaton to require notice of unlawful registration or voting in an election to be done within 72 hours is adopted. #SB1 #txlege Image
Amendment 21 by Middleton to increase access to voter registration lists is withdrawn. #SB1 #txlege Image
Amendment 22 by Swanson to give an option to affirmatively choose not to vote is withdrawn. #SB1 #txlege Image
Amendment 23 by Perez allows drive-thru voting explicitly. Fails 38-80. #SB1 #txlege
Amendment 24 by Dutton making election day a state/county holiday fails 44-75 and 1 abstention (Phelan is not at the dias). #SB1 #txlege
Dutton Amendment 25 to make county jails a polling place fails 38-82. #SB1 #txlege Image
Zwiener Amendment 26 to make student IDs from public institutions of higher ed be an acceptable form of voter ID fails 41-79 w/Harris abstaining b/c he is temporarily presiding on the dias. #SB1 #txlege
Bucy Amendment 27 to make tribal ID be an acceptable from of voter ID fails 42-77 and Harris still presiding. #SB1 #txlege
Neave Amendment 28 to allow voters w/#COVID19 symptoms to be able to vote outside polling place fails 39-79. Harris is still presiding. #SB1 #txlege Image
Klick Amendment 29 on a protocol for electronic devices in the central counting station is adopted. #SB1 #txlege Image
Amendment 30 by Slaton is adopted after verification vote (from 59-57 to 63-53) to randomly audit 4 counties every general election (2 small & 2 large counties) after a bill to do this already passed in the regular session. #SB1 #txlege
Amendment 31 by Schofield has several changes. Adopted 83-32. #SB1 #txlege capitol.texas.gov/tlodocs/872/am…
Amendment 32 by Klick & Ms. T creates a poll watcher training and certification requirement. Adopted without objection. #SB1 #txlege capitol.texas.gov/tlodocs/872/am…
Amendment 33 by Dutton requires poll watchers to register with the @TXsecofstate no later than 15 days before the election. It fails 38-80. #SB1 #txlege Image
Anchia Amendment 34 to remove the poll watcher provision fails 39-79. #SB1 #txlege
Dominguez Amendment 35 to revise current law to explicitly prohibit the poll watcher from being near voters. Murr disagrees saying the current law is sufficient as is the poll watcher oath. Fails 39-76. #SB1 #txlege
Rosenthal Amendment 36 similarly addresses the previous amendment. Fails 36-78. #SB1 #txlege Image
Turner Amendment 37 creates a defense for an election official regarding blocking the observation of the poll watcher that they reasonably asked them to move because they are violating a code of conduct. Murr opposes, says reasonableness is already in #SB1. Fails 37-77. #txlege Image
Zwiener Amendment 38 calls for transparency for poll watchers re: which campaign or party authorized them. Murr opposes. It fails 37-76. #SB1 #txlege

Clardy Amendment 39 ensures notes taken by Early Ballot Board members are kept by the County. Adopted 108-5. #SB1 #txlege Image
Zwiener Amendment 40 allows deputy voter registrar to collect and deliver vote by mail apps. She shares a story of senior constituent of hers that could've benefited from it. #SB1 #txlege capitol.texas.gov/tlodocs/872/am…
Murr doesn't want anyone other than US mail to handle personally identifiable info. Zwiener says the same info is on voter registrations. Amendment fails 37-77. #SB1 #txlege
Zwiener Amendment 41 prohibits those who encourage or participated in insurrections against state or federal gov't like the Jan. 6 Capitol one from assisting voters. Murr simply opposes the amendment. #SB1 #txlege
Biedermann (who was outside the Capitol on Jan. 6) is on the back mic asking if ppl who attended the rally insurrectionists. He also claims people have overstated what happened on Jan. 6. Amendment fails 39-76. Also this happened: #SB1 #txlege
Sorry missed an @lina4texas amendment which would've allowed universal no-excuse voting by mail before the last 2 Zwiener one. It failed 36-78. #SB1 #txlege capitol.texas.gov/tlodocs/872/am…
.@RepMaryGonzalez Amendment 43 strikes the assistor oath from #SB1. Murr opposes. It fails 38-79. capitol.texas.gov/tlodocs/872/am…
M. Gonzalez Amendment 44 would allow assistors to deaf and blind voters like an employee or a volunteer of a social service org to be exempted from a state jail felony offense for being compensated for assisting voters. It fails 39-78. #SB1 #txlege Image
Moody amendment 45 to remove the language requiring disclosure of the relationship of the assistor to the voter when using a mail ballot. Says there's no reason to ask this & the disability community testified that this will be a barrier to entry. It fails 39-79. #SB1 #txlege
M. Gonzalez Amendment 46 to strike Article 6 on Voting Assistance. It fails 38-80. #SB1 #txlege capitol.texas.gov/tlodocs/872/am…
.@Victoria4Texas Amendment 47 would add more signage for curbside voting to inform voters of their rights. She cites this @TXCivilRights report for why this is a need: txcivilrights.org/wp-content/upl…

Murr opposes. Amendment fails 39-80. capitol.texas.gov/tlodocs/872/am… Image
.@RepDominguez amendment adds a Class A misdemeanor offense to audio or video record a voter receiving assistance w/out the voter's consent. It fails 39-79. #SB1 #txlege Image
.@TurnerForTX amendment 49 clarifies that paid attendants, which can include family caregivers, who help Texans to vote w/mail-in ballots are exempted from the state jail felony offense that they received compensation for assisting the voter voting by mail. #SB1 #txlege
Turner says this provision might've been removed after passing cmte w/it intact and that's why he's adding it back in. There appears to be some confusion and there might be a drafting error in part because of amendments already adopted today. #SB1 #txlege Image
Turner Amendment 49, which clarifies personal attendants are exempted from a state jail felony offense re: not filling out certain info when assisting voters using mail-in voting, fails 40-76. #SB1 #txlege
Allison Amendment 50, which is acceptable to the author, aims to clarify some of the concerns regarding criminal offenses raised by Dem comments today (from Wu and Moody). #SB1 #txlege capitol.texas.gov/tlodocs/872/am…
Both Turners are asking Qs about this language (left) whether adding the "false or" means this would catch people who might have made a false statement mistakenly. What precedes the new lang. is what Allison says makes it work "knowingly or intentionally..."(right). #txlege #SB1 ImageImage
Now we're onto Cain's amndmnt 51, which amends amndmnt 50. It increases the penalty to a state jail felony from a Class A misdemeanor for a false statement on voter registration app if they received compensation for it. Acceptable to the author. It is adopted 78-38. #SB1 #txlege Image
Allison's amendment 50 as amended by Cain's amended 51 is adopted 80-35. #SB1 #txlege
Amendment 52 by Ms. T reduces penalties for several offenses in #SB1 from state jail felony to Class A or B misdemeanors. Murr opposes b/c these offenses have already been determined earlier in the process? Amendment fails 38-79. #SB1 #txlege Image
Walle's Amendment 53 would allow unsolicited mail ballot apps being sent by election officials to registered voters above the age of 65. It fails 38-79. #SB1 #txlege
Rose's Amndmnt 54 collects racial, gender, age & county data in voter fraud investigations & prosecutions over bills passed by #txlege. This wud be reported to the Big 3 (gov/ltgov/speaker), House Elections/Senate State Affairs Cmte members & @TheJusticeDept civil rights division
Jetton Amendment 55 is a 14-page amendment. After a quick scan, it seems like this adds a bunch of parts that were in the Senate's engrossed version of #SB1 that was never in #HB3 or the House Committee Report for #SB1. #txlege capitol.texas.gov/tlodocs/872/am…
Anchia is walking through the bill w/Jetton. 1 of the parts added an amendment to #SB1 adds the voter purge sections of the Senate's version of the bill, which includes the monthly DPS citizenship checks. Anchia asks him to walk through if this complies w/consent decree. #txlege
Jetton says he didn't draft this part of the amndmnt himself and that he received this from working w/Chairman Murr's office who has advised him that it complies w/the consent decree. Jetton says he has not talked to @TXsecofstate or @TXAG offices on whether it does. #txlege #SB1
Just checked and @JaceyJetton's amendment language on DPS citizenship check of the voter rolls matches exactly w/the Senate engrossed ver. of #SB1. If I recall correctly, the Senate's version was a result of an amndmnt worked out w/@MALDEF & @TXsecofstate on this issue. #txlege
Amendment 56 by Jetton to his previous amendment (55) is adopted. One of the things it does is add a cause of action for a candidate to sue another candidate over several voter fraud offenses. #SB1 #txlege Image
Murr clarifies on the back mic that the source of all these provisions in Amendment 55 by Jetton comes from the Senate engrossed version of #SB1. #txlege
Amendment 55 as amended is adopted, 75-33. #SB1 #txlege
Some other stuff that was in Jetton's amendment to #SB1: #txlege
Before Schofield can finish laying out his amendment (57 now) which would apparently keep federal elections separate from state elections, @TurnerForTX raises a point of order that it isn't germane to the bill. Btw, this isn't the 1st time Schofield has brought this up. #txlege
While we wait, a good reminder from @EvaRuth. The fiscal note for #SB1 as passed by the House Cmte (effectively #HB3 as filed) had a much lower local gov't impact than SB 1 as passed by the Senate. Now w/this provision, we'll see that cost go up. #txlege
Found it. So Schofield is trying to get his bill from the regular session (which died before it got to the House floor) onto this omnibus elections bill. #SB1 #txlege Image
Sounds like the Schofield amendment got withdrawn. We're onto Cain who brings amendment 58 and it's immediately adopted without objection. #SB1 #txlege Image
Zwiener Amendment 59 would require that when some1 completes their sentence, they're given notice that they are eligible to vote. #SB1 in its current form only addresses the issue on front end. #txlege
Rose Amendment 60 would delay the effective date until the @TXsecofstate can study the racial impact of the bill's changes to the elections code. It fails 37-80. #SB1 #txlege capitol.texas.gov/tlodocs/872/am…
Neave Amendment 61 would have the TX AG seek a judgment from US District Court for DC on whether #SB1 has neither a racially discriminatory purpose nor effect before the bill would take effect. Murr opposes. Amendment fails 36-80. #txlege Image
Before @RepMattKrause can propose Amendment 62 (open up cast ballots to PIR 60 days after an election), @lina4texas raises a point of order. She didn't even finish stating the grounds before the Speaker told her to bring it down front. Folx are tired & growing impatient. #txlege
Oh God. We're at hour 12 of the debate on the elections bill #SB1. Here's what the chair of the @TexasHDC had to say. #txlege
The Krause amendment seems to have been withdrawn as has the point of order. Now onto @travisfortexas Amendment 63. It is acceptable to the author and apparently the last amendment of the night. Adopted without objection. #SB1 #txlege capitol.texas.gov/tlodocs/872/am…
No one speaks for or against #SB1 tonight. Now Andrew Murr closes on the bill. Thanks members for talking to colleagues, stakeholders and constituents about it. #txlege
After 12 hours of debate, the Texas House gives initial approval to the elections omnibus bill #SB1 by a vote of 79-39. #txlege
Now onto tax bills, #SJR2, #SB8, #SB12 and #SB13. I'm signing off y'all. Thanks for following. We'll have a story out on the elections omnibus bill in the AM. #txlege
Correction: The 2nd reading vote on #SB1 was 79-*37*. #txlege Image
