COWIN launched a ‘Know Your Customer/Client’s Vaccination Status’ on September 10, '21 which claims to be: consent-based and privacy preserving. But is it really? 2/n
This API will allow government & private entities to instantly know the status of vaccination of an individual. It will also legally allow an enterprise/employer to know the vaccination status of their employee.
But the new API cannot do this without breaching your privacy. 3/n
Your vaccination status is private and confidential health information, and KYC-VS violates COWIN’s existing privacy policy by sharing your vaccination details with third parties.
Your sensitive medical data is now at risk of misuse & no legal recourse exists for citizens. 4/n
Although the evidence on vaccines preventing serious illness & death is well documented, its efficacy against preventing transmission isn’t.
Such a serious misunderstanding could lead to unjustified discrimination & laxity in public health measures! 5/n
This API will only create more issues where we don’t need them.
Before enabling its indiscriminate use, India must create a policy on vaccine mandates to prevent unfair and unjustified treatment. 6/n
Our recommendations:
- Amend COWIN's privacy policy to ensure the privacy & security of data shared with third parties.
- Introduce a clearly defined policy on vaccine mandates keeping in mind current evidence, health and safety requirements & fundamental rights. 7/n

We have come across reports that the internet has been shut down in parts of UP. To our knowledge, no official order has been published by the government as of yet. Please reach out to us if you have more information regarding the shutdown or if you need assistance. (1/n)
Last week, several districts in Rajasthan also arbitrarily suspended internet services purportedly to prevent cheating in an exam. We addressed letters to the officials responsible for the suspension, pointing out legal concerns with their orders. (2/n)
We had also addressed a representation to the Government of Haryana when last month internet services were suspended in the wake of farmer protests without official publication of the orders. (3/n)
Several districts in Rajasthan faced an internet shutdown yesterday.
Why? To prevent cheating in an exam.
We worked through Sunday and wrote to the Rajasthan govt. to lift the internet suspension, and to exercise restraint in issuing such orders.

We pointed out that the SC in Anuradha Bhasin v. Union of India has held that internet suspension orders can only be issued by the Home Secretary of the State Govt. in cases of emergency through a prominently published order that discloses clear reasons.

The orders, which were issued by Divisional Commissioners instead, refer to a need to prevent cheating and a mere apprehension of danger to public order. This is not a public emergency which justifies the extreme step of suspending internet services in entire districts!
