Supreme Court is hearing pleas challenging the rehabilitation policy including the eligibility criteria framed by the Municipal Corporation of Faridabad with respect to the demolitions at Khori Gaon #khorigaon
Haryana AAG Arun Bhardwaj : When matter was filed initially before Chandigarh HC, Aadhar was not their basis. A list of Documents are required for preparation of Aadhar card
SC: Bench: We were saying for grant of provisional allotment, go through whatever documents they have
Justice Khanwilkar: go through to show their residence, which will later be verified by you. Can’t that be done counsel?
AAG: to that extent it’s possible. We are not inclined to take it as a proof, that is our submission
Justice Dinesh Maheshwari: it has to be cross checked by the corporation...
Justice Khanwilkar: let them apply on the basis of aadhaar.. it will not be a proof. they have to establish their eligibility for final allotment
SC: Let aadhaar be used to apply for provisional allotment
AAG: Parivar pehchan patra was a document for eligibility. we had submitted our reply..the scheme started in 2019 and it is being updated last on jan 12, 2021. aadhar card , voter i card, birth certificate etc is needed
AAG: Aadhaar is mandatory for the parivar pehchan patra.
SC: Our suggestion is, which he says seems to be acceptable, is that you will apply based on Aadhar. Then later you have to establish your eligibility under the scheme as propounded. This is only for provisional allotment
AAG: But let it not be used for final allotment #supremecourt
SC: there is a problem that there may not have all documents as they have lost
AAG: provisional we have no difficulty, but if in final allotment they have only aadhar, that may not be done
SC: we have heard counsels of nature of proof to be submitted to avail rehabilitation scheme, for the time being we direct the corporation to allow applications for provisional allotment by aadhaar card or parivar pehchan patra upon verification.
SC: This will not create any right in favour of any such person unless the person establishes eligibility as mandated under rehabilitation scheme. This observation is for interim attangement and subject to outcome of pending proceeding.
SC: AAG has assured all deficiencies in e portal will be looked into and dealt with appropriately. we call upon the corporation by upgrading the portal by providing information in respect of matters referred to paragraph 5 of representation dated October 1, 2021
Matter to be heard next on october 22, 2021 #khorigaon
