@SpectrumNews1WI Two more jurors have been let go because they told the judge they could not hear what was happening during the morning session.
22 have now been dismissed.
@SpectrumNews1WI New Question from the judge: Is there any of you who will not try this case fairly and reach a just and true verdict.
- Anyone who cannot read/speak English?
- Anyone who doesn't reside in Kenosha County
-- another one is struck. Second one who now lives in Chicago. 23.
@SpectrumNews1WI They've brought over some of the potential jurors from the overflow room and gave the oath
There is some sort of issue the lawyers were going over, but it's unclear what is going on.
Juror 57 dismissed. Schroeder said they will get a letter for future jury service.
24.
Asst. Dist. Attorney Binger is now asking the panel of 34 potential jurors questions.
First was if they participated in any of the demonstrations after the #JacobBlake shooting, or if they had friends or family who did.
One juror is speaking but is not audible.
Her granddaughter participated in marches, and she said her granddaughter's involvement would affect her decision making "a little bit."
Does not think she can keep an open mind throughout the case.
She's been released.
25 removed.
Another potential juror said her son was there during protests but doesn't know what night. Said it wouldn't affect her.
Another said friends from church went. Doesn't remember the night. She didn't participate.
Next Question: How many of you were personally affected by arson/looting/rioting? Property, business, etc.
No one.
Moving to friends/family.
One's daughter had a business downtown. It was boarded up and then closed. No property damage, but lost business.
One said his coworkers live in apartments near the car lot that was set on fire. Said it probably wouldn't affect his ability to be fair and impartial.
NEXT QUESTION: How many of you took steps to stay safe? Including boarding up, getting firearms, etc.
There are several who did/were concerned about damage and looting. Saying they took precautions.
NEXT QUESTION: Anyone feel it's inappropriate to protest for something like the #JacobBlake shooting, and knows there's a difference between protesting and rioting/looting.
No one disagreed.
Also -- No one disagreed that human life is more important than property.
Binger asks the potential jurors if they have friends who are so dead set on one side or the other, if they'd be afraid to make a decision in this trial and then face them.
Juror 15 said she doesn't care about facing friends, but facing her husband. "very opinionated."
Binger asks her if it would be hard to not discuss the case with her husband at the end of the day. She said no, but it would be hard after the case is over.
Binger said he doesn't want jurors to feel that pressure.
The juror didn't want to answer. Binger asks to excuse her.
Defense attorney Mark Richards is now questioning.
"Would that feeling or your concern sway how you viewed the evidence in the case?"
It is hard to hear her answers. she's not mic'd.
Judge asks to move on as the juror is upset, discussion to continue later. Not removed (yet)
Another juror said she talks with her sister daily. Binger asks if it's too much to ask for her to not discuss anything about this case for as long as the trial goes on.
She said she doesn't know. Schroeder interjects and said he could sequester her, and her alone if necessary.
She said she'll tell her sister to not call her, because she doesn't want to be sequestered.
There is some laughter from the judge and others in the court room
Another juror is explaining an anxiety induced form of IBS.
Judge said they can discuss later. Juror said a break right now wouldn't help. #RittenhouseTrial
None of the 34 potential jurors on the panel have given money to #KyleRittenhouse or his defense.
Binger is now asking some of the potential jurors about their employment and education based on the information they submitted #RittenhouseTrial
COURT ON RECESS
~ about 10 minutes. Should resume around 2:43 p.m.
We can't see him on the feed (only the judge is visible to protect the privacy of the potential jurors) but Defense Attorney Corey Chirafisi is the one asking questions now.
The judge and attorneys are conferencing right now I believe. The camera feed has moved above the bench. Was a few minutes of silence.
Back in business now -- defense asking the panel if anyone has taken a concerted effort to follow the case
-- No hands raised.
Another juror has been dismissed. That's the 26th juror for the day.
She was dismissed because she said if someone owns a gun like Rittenhouse used (AR-15 style) she'd assume they were guilty on all charges. She doesn't think anyone should own that kind of gun. #RittenhouseTrial
27th dismissal -- this time because of medication needed. #RittenhouseTrial
Another juror is now noting their opinion on the style of gun #KyleRittenhouse used.
She said she considers that a machine gun, and doesn't think anyone should have those.
She said she would try her best to be neutral about it.
One juror is expressing her fear of being seated on this jury.
Defense is asking the panel if anyone else feels that fear about the pressure of reaching a verdict.
Another juror said she's afraid of the community and outsiders coming in.
Said she has concerns a specific verdict could bring problems.
"The judge said this isn't a political case" but said it doesn't stop the politics outside the courtroom. Said people are going to do what they do.
Said that wouldn't affect her ability to be fair and impartial, just said she worries about the unrest.
Judge said he has never had any incident in any of his or other judges courts involving any peril to the jurors. #RittenhouseTrial
She clarifies and said she's not concerned about her safety, but the community's safety as a whole.
Another juror has been excused. I missed the reason why -- but that's 29.
Another potential juror said he has a trip scheduled for Nov. 19 -- judge said that should be beyond the end of the trial.
The juror also raised a concern with the weapon used. #RittenhouseTrial
Another juror being asked about anxiety about being seated on this jury. Asked if it is something she can put aside.
Said she saw businesses already boarding up. Said she took a lyft to the courthouse today, didn't want people to see her car.
Said it wouldn't impact fairness.
Another juror saying she wants to serve on a jury but not THIS jury.
Called the judge a "guilt tripper" but is concerned about people knowing she's on a jury and doesn't want people knowing she's on THIS jury because it's on the news all across the country.
Said she wants to know how the jury would be protected.
Judge said those are legit concerns and is now addressing it -- said "You're never obliged to talk with anyone about the case [after the verdicts are reached]."
Said in years of trying cases -- never had juror threatened
Asked her when the last time she heard a juror was threatened. She said she watched a movie. Judge laughed.
Said it's minimal risk and you don't hear about it often. Reiterates that he's never seen anything close to it.
Judge laughed about the "guilt tripper" comment, by the way.
Defense now asks te panel if anyone doesn't believe in self defense being used as an argument in court.
The state is calling Dominick Black to the witness stand. #Rittenhouse trial
Dominick Black has taken the stand. He dated Rittenhouse’s sister.
He bought the gun #KyleRittenhouse the AR-15 used on August 25, 2020.
Rittenhouse was 17 and not legally allowed to own that gun. It stayed at Black’s dad’s house. #RittenhouseTrial
Black said he didn’t want to buy it since he was 17, and they agreed he wouldn’t possess it till he was 18. So it stayed at Black’s dad’s. The gun was legally registered to Black, paid for by Kyle Rittenhouse. #RittenhouseTrial
@SpectrumNews1WI The judge is playing his Jeopardy game (reading trivia questions from his tear-off calendar) with the jury while the state and the defense make their strikes.
Unfortunately, for this game, there is no Double Jeopardy in court...
