Update: ANL lost their appeal in the copyright lawsuit vs. #MeghanMarkle. The summary judgement that Justice Warby issued will stand. Meghan won both the copyright & privacy claims. ANL can still ask to appeal to the Supreme Court but success is unlikely.
“The publisher of the Mail on Sunday has lost a legal battle to overturn a High Court ruling on its publication of a letter written by #MeghanMarkle to her estranged father.” independent.co.uk/news/uk/home-n…
“Today, the courts ruled in my favor—again—cementing that The Mail on Sunday…has broken the law. The courts have held the defendants to acct,& my hope is that we all begin to do the same…These harmful practices don’t happen once in a blue moon—they’re a daily fail” #MeghanMarkle
“The Court of Appeal…upheld the judge’s decision that the Duchess had a reasonable expectation of privacy in the contents of the Letter. Those contents were personal, private & not matters of legitimate public interest [84].”
“The articles in the Mail on Sunday interfered with the Duchess’s reasonable expectation of privacy, & weren’t a justified or proportionate means of correcting inaccuracies about the Letter contained in an article published on 6 Feb 2019 in People magazine…([95] & [106])”
“The Court of Appeal commented that the new evidence that had been provided to it had also been widely publicised in the press, nationally and internationally [68]. In those circumstances, it decided that the new evidence should be admitted as a matter of pure pragmatism”
“Despite finding the new evidence of little assistance [70], the CoA noted that the Duchess had apologised to the court for the pleading served on her behalf…It had appeared from new evidence from Mr Knauf that he had provided some info to the authors…with the DoS’s knowledge”
“The Court of Appeal said that this was, at best, an unfortunate lapse of memory on her part, but did not bear on the issues, and had been given no prominence in Associated Newspapers’ oral argument [71].”
“A crushing judgment in her favour in the High Court has now been followed by an equally crushing unanimous finding from three of the country’s most senior judges.” #MeghanMarkle#MeghanMarkleWon
I just wanted #Leveson2 but I f #MeghanMarkle is responsible for the UK creating a bill of rights, I hope they put up a statue in her honor. 😂💅🏾 #HerPower
The #DailyFail’s case was so weak that 4 judges told #MeghanMarkle to stay home because a trial wasn’t worth her time or theirs. She beat them from her couch. 😂
“It’s a big win for the #DuchessOfSussex, and it raises the question: why on earth did the Mail continue to appeal against the judgment made against it earlier this year?”
Brian Cathcart explains that the public was misled about the particulars of the case throughout the (trial and) appeal. Not surprising when the defendant is also reporting on the case but it’s a stinging indictment of the rest of the British press core.
“Meghan first won her case in February. It was and remains a major victory for the #DuchessOfSussex who has been continually targeted and abused by British tabloids since joining the royal family.”
“Despite prompting from the bench, Associated Newspapers has not, even after a two-and-a-half day hearing, clearly identified the triable issues that falsify this reasoning.” lawgazette.co.uk/news/mail-lawy…
#PrinceHarry “spoke with another set of [@DianaAward Legacy Award] winners from around the world in a virtual meeting held from his home in Montecito, California.”
“The princes' paid tribute to the young people from around the world who are #LegacyAward winners — the most prestigious accolade a young person can receive for their social action or humanitarian work that is handed out by @DianaAward every two years.”
“Among those Harry spoke w/ was a woman from the US Dian Chao, 23, from LA, who runs Letters to Strangers is receiving an award. Another American set for a #LegacyAward is Jahin Rahman, 18, from New York, who founded the non-profit Efforts in Youth Development of Bangladesh.”
“The gulf between what the public is being told about this case and its reality is so wide the two may be described as parallel universes, as was vividly illustrated by the hysterical scandal of the Duchess’s apology.”
“So why did the Mail & its allies make so much of it? What do they have to gain from creating this parallel universe? On 1 level the answer is simple. They hate the Duchess & so the slightest embarrassment 4 her brings them a joy to be celebrated as luridly & loudly as possible.”
“they are up to something more subtle: grooming the public to think that the evidence is all on their side. […] In suggesting that the Duchess is bound to lose, the UK corporate papers seem to be setting their readers up to be surprised when, as is ultimately likely, she wins.”
On the one hand,I’m happy that so many people in Nottingham will be helped by Meghan’s donation to @wearehimmah. OTOH, I’m so incredibly fvcking angry that the character assassination perpetrated by the UK media & sanctioned by the palace made the trustees question announcing it.
The charity accepted & spent the money, so clearly their issue wasn’t with Meghan’s values but with public perception, despite the work she & Harry have put into the Nottingham community supporting projects like Full Effect & the Community Recording Studio.
Meghan even made a solo visit to Nottingham Academy to mentor students & invited one to attend their wedding. She went on to be secret pen pals with another student recovering from a brain tumor. bbc.com/news/uk-englan…
“I’m resigning from my position on the board of the SoE. I didn’t do so in the immediate aftermath of Ian Murray’s statement saying the UK press wasn’t bigoted b/c I was assured by fellow board members that a robust rebuttal...would soon be forthcoming” pressgazette.co.uk/eleanor-mills-…
“Two weeks after the extraordinary board mtg in the wake of Murray’s departure that apology & clear statement about the Society’s current view in regards to whether the lack of diversity in our newsrooms amounts to structural racism in the UK media is still not forthcoming.”
“I have lost confidence in the SOE ever delivering such a statement. Unlike many board members I have no institutional ties keeping me from resigning on this matter of principle, so today that is what I am doing.”
“Not only was I not being protected, but they were willing to lie to protect other members of the family” she said. “They weren’t willing to tell the truth to protect me & my husband”
“Members of the BRF rarely issue personal statements, and the family’s media team rarely goes on the record with the press in response to a story or request for comment. (BP didn’t provide an on-the-record response for this article. A spox for the Sussexes said, “No comment.”)”
“It’s important to understand the outsize influence the Palace press office wields as it manages the UK media’s voracious hunger for royal family coverage. It can try to kill false or misleading stories before publication (journalists have said as much)”
