My response to Governor Brown's comments today:
John C Calhoun, who popularized the theory of nullification before the Civil War, also thought enforcing federal law was an "act of war," but every student of American history (except the Governor of California it would seem) knows that debate was settled at Appomattox Courthouse
In fact, the only war that has been declared by the Attorney General and the Trump Administration is on violent crime, transnational criminal organizations, and the drug crisis.
These are national problems that are exacerbated by states like California when they put federal law officers at risk by refusing to share even the release date of a criminal illegal alien that they themselves believed were dangerous enough to arrest in the first place.
In the meantime, law abiding Californians are the victims. For example, just last fall local police in Northern CA arrested an illegal alien for spousal battery. ICE asked to pick up the person to begin removal proceedings but instead that person was put back on the streets.
Shortly thereafter, that same individual--who should have been deported--was arrested on charges of murder. This should shock the conscience but instead it's business as usual in California.
The Attorney General didn't create this issue. But he cannot accept unconstitutional interference with federal law enforcement from any state. That is why this lawsuit was filed and that is why we expect to win.
