NEW: Federal prosecutors have filed their sentencing memo on Michael Cohen. It's not kind. They say his crimes "were marked by a pattern of deception that permeated his professional life."
Federal prosecutors in New York say Michael Cohen should receive a "substantial term of imprisonment," even after giving him some credit for his cooperation with Mueller's investigation.
President Trump makes an appearance in DOJ's sentencing memo for his former lawyer, Michael Cohen. He is "Individual-1."
This is new. Federal prosecutors have said for the first time in a court filing that Cohen committed campaign finance crimes "in coordination with and at the direction of" President Trump.
This is significant. The Justice Department is alleging in court that the president directed his onetime lawyer to commit two felonies.
Prosecutors are downplaying the extent of Cohen's cooperation. They say he "repeatedly declined to provide full information about the scope of any additional criminal conduct in which he may have engaged or had knowledge."
Prosecutors say Cohen provided them information "about the participation of others in the campaign finance crimes to which Cohen had already pleaded guilty." They assessed him to be credible and said his information was consistent with other evidence.
Meanwhile, Mueller's office says Cohen has "gone to significant lengths to assist the Special Counsel's investigation." The information he provided was "credible and consistent with other evidence."
Mueller too refers to the president as "Individual 1."
Mueller's office says that in Nov. 2015, Cohen “received the contact information for, and spoke with, a Russian who claimed to be a ‘trusted person’ in the Russian Federation who could offer the campaign ‘political synergy’ and ‘synergy on a government level.’”
Mueller says Cohen also provided the special counsel information about "certain discrete Russia-related matters core to its investigation" that he obtained by being in contact with Trump Organization executives.
And Cohen provided information "concerning his contacts with persons connected to the White House during the 2017-2018 time period."
And Cohen provided information about the circumstances in which of "preparing and circulating" his responses to congressional inquiries, some of which he has acknowledged were false. So .... circulated to whom?
Mueller's bottom line: Cohen's crime was "serious" and "the sentence imposed should reflect the fact that lying to federal investigators has real consequences, especially where the defendant lied to investigators about critical facts, in an investigation of national importance."
Meanwhile, federal prosecutors in Manhattan say Cohen declined to provide them information "about other areas of investigative interest," suggesting that DOJ has its eye on potential criminal conduct around Cohen beyond the campaign finance violations.
Don't miss footnotes: President Trump conferred with Cohen in 2015 about reaching out to the Russian government to arrange a meeting with Putin when he was in New York.
Cohen's lawyers told prosecutors in Manhattan he had "determined not to fully cooperate" with them. Such an arrangement would have required Cohen to disclose other crimes he may have committed, for which he wasn't charged.
DOJ says the campaign violations Cohen committed to aid Trump's campaign were "stirred, like his other crimes, by his own ambition and greed." He told friends in text messages obtained by the FBI that he "expected to be given a prominent role and title" in the administration.
DOJ says Cohen's crimes "reveal a man who knowingly sought to undermine core institutions of our democracy."
It has not escaped DOJ's attention that Cohen threatened journalists and bankers alike.
DOJ: "After cheating the IRS for years, lying to banks and Congress, and seeking to criminally influence the Presidential election, Cohen's decision to plead guilty - rather than seek a pardon for his manifold crimes - does not make him a hero."
