Biery repeatedly asking if SOS considered naturalized citizens could be on list of flagged voters.

AG lawyer: Focus was on noncitizens, not naturalized

Biery: If somebody was born here, they couldn't be a noncitizen so theres a different standard for native born & naturalized?

AG lawyer hammering point that county voter registrar has discretion to investigate flagged voters/take no action if no reason to doubt eligibility. But local officials have told me they can’t just ignore list. One said he’s gotten calls from public insisting on investigations.

Reminder: Some county officials said they had no way to independently confirm citizenship of flagged voters & instead followed state’s guidance about sending out proof of citizenship letters. Those local officials are now being sued in separate lawsuit: texastribune.org/2019/02/04/civ…

Despite state's guidance on reviewing voters, AG's office is telling counties that immediately sent out proof of citizenship letters that they acted improperly.

"Unfortunately, Mr. Reeves, I think your staff has acted contrary to state law," lawyer tells Kerr Co voter registrar.

AG lawyer contends SOS guidance did not say they should immediately send out proof of citizenship letters but that they should determine whether to investigate.

Kerr Co voter registrar says SOS guidance + statements by top Republicans indicated to them they could act on list.

6.5 hours later hearing in case to block Texas voter citizenship review is done for the day after questioning of DPS official who helped compile data & plaintiff Julie Hilberg who was emotional on stand as she talked about learning she was on list. Back tomorrow at 9:30 am.
