Gorsuch is not pleased with a law that allows a judge—not a jury—to send sex offenders back to prison after determining that they've committed a crime. A remarkable defense of the Sixth Amendment here. supremecourt.gov/oral_arguments…
Gorsuch is deeply committed to the right to a trial by jury. Today he and Sotomayor once again teamed up to defend it—though this time, a majority of the justices seem to be on their side. (Alito still doesn't really believe in the Sixth Amendment.)

If Amy's prediction is correct, this case will impose a very welcome restriction on a draconian sex offender law.

Majority opinion by Kagan: If an inmate suffers a mental disorder (like dementia) that renders him unable to understand why the state wants to kill him, the Eighth Amendment prohibits his execution.

North Carolina court declares recent voter ID and tax cap constitutional amendments INVALID because they were voted onto the ballot by a racially gerrymandered state legislature. A ruling of extraordinary breadth.

This is a fascinating decision from the Georgia Supreme Court holding that a driver's refusal to take a breathalyzer test cannot be used against her in court—under the state constitution's guarantee against self-incrimination. gasupreme.us/wp-content/upl…
What's perhaps most fascinating about the decision is a lengthy discussion of the "original public meaning" of a state constitutional provision that was first adopted in 1877—but has since been readopted in several new constitutions. An originalist scholar's dream.
The court applies the presumption of constitutional continuity to hold that "a constitutional provision retained from a previous constitution without material change has retained the original public meaning that provision had at the time it first entered a Georgia Constitution."

never did any actual, real live lobbying for Turkey or Russia.

He just merely....

1) Created a lobbying group, The Flynn Group
2) Accepted contracts from Turkey & Russia
3) Accepted payment for lobbying

You can do all 3 of those things & NOT break the law.
Not until you actually ACT on behalf of a foreign client by engaging in real live lobbying have you committed a crime if you did not register as a foreign agent under the FARA act.
Paul Manafort was charged for FARA violations.

So was his business partner, Rick Page.

You know who HASN'T been indicted for any FARA related shenanigans?
