Trump lawsuit against Elijah Cummings to quash House Oversight Committee subpoena for financial records. Reads like a stall tactic to me; hard to see a court realistically finding this out of bounds. assets.documentcloud.org/documents/5973…
Or, at any rate, to the extent the subpoena needs to more clearly articulate a legislative purpose, it doesn’t seem like it would be terribly difficult for Cummings to cure the deficiency.
The complaint here draws heavily on precedents from the HUAC era, where the Committee sought to compel people to discuss their political beliefs & associations. The analogy seems a bit strained.
Most of those cases involved thorny 1st and 5th Amendment questions not really at issue here. Conspicuously missing from the suit is any mention of or effort to grapple with McGrain v. Daugherty. supreme.justia.com/cases/federal/…
