Last night, we got the latest status report in the Ms. L family separations class action: assets.documentcloud.org/documents/6191… A few highlights: Five more kids, whose parents were *not* in the class, were discharged from govt care (such as to sponsors)
There is still one kid left in ORR care who was part of the *original class period*, meaning they were separated as of June 2018 — no timeline for discharge, and it's clear if they'll be released to a sponsor or reunified with a parent (not in the United States)
Here are the latest numbers re: family reunifications and other outcomes for separated kids
As for the newly approved expanded class of separated families, we're getting the first set of numbers — per ACLU, the govt has identified another 791 kids separated from a parent at the border
The ACLU has also asked the govt for assurances that families subject to removal orders who are covered by a settlement agreement won't be swept up in the anticipated raids this weekend; they say they haven't gotten a response from the govt yet
A hearing is now underway in the case, where the judge will go over these numbers and also hear arguments on a motion to allow 21 parents who were deported to come back to the US to be reunified with their kid assets.documentcloud.org/documents/6191…
DOJ lawyer says that ICE recently confirmed that they're aware of the settlement agreement in the family separations litigation and says procedures are in place to protect any class member who is picked up

Notable: At today's hearing, the govt official overseeing the process to ID the expanded class of separated families says that when a file came back as negative (not eligible), they did a re-review, and on average, 7 out of every 1000 files came back positive (eligible)
The HHS official, Commander Jonathan White, says HHS has gone through all of the 32,972 case files for immigrant kids in their care during the time period at issue, and the interagency vetting process to confirm who is eligible to be in the class of separated kids is ongoing
