9th Cir. revives lawsuit from Montana prisoners with serious mental illness who say they are being denied treatment in violation of the Eighth Amendment.

The case is being reassigned to a different judge on remand because the previous judge misunderstood which case this was (confusing it for a case by the same plaintiffs raising different claims against a different defendant), but then refused to correct the error.

Also, there was a giant honkin' zucchini at the bottom of the bag that is the platonic ideal of a zucchini. Guess that one's going on the grill tomorrow.

7th Cir. holds no 1st Amendt violation for a sentencing judge to take into consideration defendant's white supremacist ideas and hatred for the U.S. even though these were unrelated to his crime.

Holds these ideas were evidence of future dangerousness.

Although, the opinion doesn't claim to rely on it, the court nods toward the "magic incantations" standard of constitutional review.
It seems to me incanting "I'm totally not doing what it looks like I'm doing" wouldn't work for anyone else. Don't think it should work for district courts either.

Oh boy, fireworks in opinions out of the en banc 4th Cir. today. Will post when it hits the court's website, but a preview: principle dissent suggests the majority are chumps, says that the maj. op. should be void for vagueness, and that they don't care about abused women.
This draws a rebuke from three judges concurring: "I express hope that we will turn away from the use of inflammatory language, which diminishes the value of our work."

To which the dissenter specially replies: civility may censor dissenting voices.
If you've been following along, you can probably guess who wrote the, er, animated dissent.
