1/ If an act is unconstitutional, and it's "clearly established" that the act is also a crime in which officers may not engage or that dep't policy would prohibit the act, then a plaintiff shouldn't have to *also* show that the act's unconstitutionality is clearly established.
2/ The "clearly established" law prong of qualified immunity is all about notice to officers & ensuring zealous law enforcement. The Supreme Court doesn't want police held unexpectedly liable based on activist judges' unpredictable ex post facto decisions to create new rights.
3/ But if there are already binding sources of law, such as state criminal law, that clearly establish an act as prohibited, then officers already know they may not engage in that conduct. They already have adequate notice they shouldn't be engaging in such conduct.

In Miller v. AT&T, 344 F. Supp. 344 (ED. Pa. 1972), AT&T shareholders sued AT&T, seeking a PI barring it from providing phone service to the 1972 Democratic National Convention, on the grounds the DNC had failed to pay its $1,477,638 phone bill from the 1968 convention. They lost
Among other things, the Democratic National Committee promised to hold - wait for it - a *phonathon* to raise money to pay the overdue phone bill.
Perhaps there is something to be learned from the Lannisters on the issue. As a postscript, phone service was provided to the 1972 national convention, but it's unclear whether the phone bill ever got paid.

Just had my second election law class! We explored the role of voters in our democracy, contrasting direct & representative democracy; examined different theories of democracy; and began discussing the five different meanings of the “right to vote,” starting w/ voter eligibility
2/3 We had a great discussion over the extent to which elected officials should follow the will of their constituents in a functioning democracy.
3/3 One thing I especially enjoy is linking election law to students’ other classes, like administrative law. We talked about relationship between voting & nondelegation doctrine, which lets unelected officials make policy, as well as political insulation of independent agencies
