Those contemplating that the Inner House was biased and political because it found against the Government must, also, contemplate that the Divisional Court was biased and political because it found for the Government.
In the real world, away from the synthesised outrage of twitter, we all know that how judges think about their role is influenced by their experiences and the world around them - that's why it matters so much that our judiciary is overwhelmingly white, male and from privilege.
The Government set up a working group on a general anti tax avoidance rule and that - rather starry - group more or less said that one of the reasons why we need such a rule was because they feared judges were doing violence to the law in order to deliver the 'right' outcome.
