1. As you wait for Justice GEorge Chiweshe to hear & decide the case of Dr Peter Mugombeyi, here’s a little story to entertain you. In December 2016, Justice Clement Phiri issued an order of eviction against Grace Mugabe & others. They had been sued by Lebanese businessman Ahmed
2. A few weeks later, Jan 2017, an application came before Justice Chiweshe seeking to “correct” the order made by Justice Phiri. Justice Chiweshe proceeded to “correct” his fellow judge’s ruling relying on .. you guessed right, Rule 449 of the High Court Rules!
3. Months later, the matter came before Justice Chiweshe again & he ruled against the Mugabes, effectively restoring the order of Justice Phiri which he had “set aside”. So what had happened to cause this flip-flopping? Well, change of power had happened.
4. When Justice Chiweshe “corrected” Justice Phiri’s order in 2016, Mugabe was still in power & Grace was First Lady. When months later, Justice Chiweshe effectively restored Justice Phiri’s ruling which he had “corrected”, Grace was no longer First Lady. The coup had happened.
5. So ruminate on this as you await Justice Chiweshe’s ruling on the application to “correct” a decision of a fellow High Court judge in the Dr Magombeyi case. It might be a good idea to lower your expectations in case you had any. Anything unusual would be a pleasant surprise.
