In case we thought that the DOJ Civil Rights Division might still be in the civil rights business, they’re confirming. They’re not.
Last year DOJ filed a Statement of Interest in the case challenging affirmative action at Harvard, on the side of the org seeking to end affirmative action. The year before they filed a Statement of Interest in the Chicago policing case, seeking to stop the consent decree.
These are cases in which the United States is not a party. The DOJ is using Statements of Interest to aggressively promote an anti-civil rights agenda. It's shameful.

Today we filed an amicus brief in the U.S. Supreme Court on behalf of 10 Civil Rights Litigating Organizations in a case that may strike a devastating blow to the integrity of our nation’s oldest civil rights statute. #ComcastvNAAAOM naacpldf.org/wp-content/upl…
The case involves the standards for claims brought under 42 USC Section 1981, which derives from the Civil Rights Act of 1866. This statute speaks explicitly abt the intention of its framers to ensure that all ppl have the same economic & legal rights as “white citizens.”
The purpose of the statute was to ensure that African Americans would be on equal economic and legal footing with white ppl after the end of the Civil War. Section 1981 covers discrimination not only by states, but by private parties as well.

No matter what else is going on, we don't take our eyes off judicial nominations. And the nomination of Steven Menashi to the 2nd Circuit Court of Appeals has particular significance for @NAACP_LDF . Our founder, Thurgood Marshall, was nominated for that seat in 1961.
@NAACP_LDF Last wk we submitted a ltr to Senate leadership opposing the confirmation of Menashi. Our opposition is based on his appalling record of stmnts & actions that are contrary to the principles of equality & justice every fed judge shld embrace, & to which Marshall devoted his career

2/ The US Atty cites statutory authority to “to attend to the
interests of the US in [any] suit pending in a court of the US.” That's interesting, because this is a case Trump filed to keep Manhattan DA from getting his taxes; to keep the grand jury from investigating him.
3/The Southern District says it may want to assert "that Article II, the Supremacy Clause, and the structure of the Constitution
preclude subjecting a sitting President to state criminal process, including grand jury
subpoenas directed at the President or his agents."
