#USS is not making public the secret legal report which led to the sacking of #USS trustee and whistleblower, Prof Jane Hutton.

Prof Hutton had provided formal consent to #USS for an Executive Summary of the report, prepared by legal firm Slaughter & May, to be published.

I asked #USS whether they would now publish the Exec Summary, given Prof Hutton had consented to this.

A USS spokesperson said: “As Prof Hutton has initiated legal proceedings against USS, we cannot now comment further on matters that may be the subject of such proceedings.”
The report by Slaughter & May was commissioned by the #USS and investigated Prof Hutton's role as #USS trustee and executive director.

Prof Hutton was sacked from the #USS trustee board, following the report.
I understand that the Slaughter & May report, which has been kept secret, contained criticisms of the #USS trustee board.

The recommendations relating to the operations of the #USS Trustee Board have not been made public to members.
I understand the Pensions Regulator was sent a copy of the secret Slaughter & May report.
Prof Hutton has initiated legal proceedings in the Employment Tribunal, against #USS, for unfair dismissal.
I asked the Pensions Regulator what it intended to do with the Slaughter & May report into Professor Jane Hutton and the #USS trustee Board.
The Regulator said it was not commenting.

On the sacking of Jane Hutton from the #USS Board, here's what I understand:

- Sir David Eastwood, chair of the #USS trustee board, conveyed news to Prof Hutton today;
- "Material breaches of obligations" cited as reason for her role as non-exec director being terminated.
- The decision to sack Prof Hutton was made by #USS trustee board and was unanimous. The board is made up of university employer & union representatives.
Prof Hutton was appointed to the board by the University and College Union.

@Cooperannuation @FT Deferred annuities have been launched Down Under.

These annuities are bought at age 65 but don't start to pay an income until the policyholder reaches 85.

There has been much talk about the role Deferred Annuities could play in the UK.

@Cooperannuation @FT In a real example, an Aussie who bought a $10,000 deferred annuity at 65 would receive an annual income of $1741 a year from age 85, if they survived to that age.

So the retiree has a 20-year window to spend down their capital knowing they will have a secure income from 85.

On the eve of the critical Brexit vote, the Government is accused of “sneaking out” changes to pensioner benefits that could cost mixed aged older couples more than £7000 a year. The DWP announcement was published around 7:20 tonight.

The minister is announcing changes which will reduce access to pension credit for couples where both are not over state pension age.

Pension credit tops up the incomes of the poorest pensioners.

Currently, a household can claim pension credit if one member of the couple is over state pension age, and the other is under SPA.

The #USS executive, led by Bill Galvin, fear scrutiny & transparency, and they will go to any end to avoid it ...
The #USS executive had promised to release this Executive Summary as soon as Prof Hutton's consent was obtained. Now they have U-turned.
Separately, #USS have been dragging their feet in providing technical documents to the Pension Regulator. It took them 9 DAYS to pass on these requested documents to tPR by email ...

It seems VCs at @USSemployers are struggling to understand what they need to do to end the threat of heavy industrial action over #USS, and I'm appalled by how little "leadership" we're seeing from such highly paid servants of the sector. Let me enlighten them. 1/
The legal terms of the dispute couldn't be clearer. We want @USSemployers to pick up the highly controversial increased costs of the scheme, which lack a solid justification. We have spent years pointing out why, and have been vindicated by an independent expert report. 2/
So on one level, this story's very simple: agree to limit our contributions to 8% of salary, and this goes away. But that won't in itself solve the huge problems underyling why costs have soared. To fix that problem, a major intervention from @USSemployers is necessary. 3/

Jane Hutton's suspension followed shortly after an email she wrote to me, the JNC chair, and one of UUK's negotiators. The reaction this email received from #USS CEO Bill Galvin makes me believe he considered it a breach of her responsibilities. 1/
My guess is that this email formed part of the case that #USS assembled against Jane and resulted in her being fired on Friday. This is only guesswork, as the report is kept in a locked room and has not (and will not) be published. So what was in Jane's email? 2/
Jane's email, sent on 13 May, contains three occurrences of problems in board papers intended to inform decisions on the valuation. She said that she considered it her fiduciary duty to inform the JNC of these matters, and told the board she was doing so. 3/

With all of the attacks on the Intelligence Community #whistleblower whose Complaint was publicly released to Congress, it’s time to review some basic principles of federal #Whistleblower protection law.
In 2012, Congress strengthened the #Whistleblower protections for federal employees. In 2013, President Obama extended similar protections for intelligence community employees through a presidential directive & in 2014 Congress codified those protections for Intel employees.
Under the 2013 presidential directive, any #whistleblower reprisal claim must be adjudicated consistent with the policies and procedures used to adjudicate reprisal claims filed under the Whistleblower Protection Act, 5 USC 2302(b)(8).

Firstly, why a ballot? When the Joint Expert Panel's report dropped in September, there was hope from all sides that it had the potential to end the dispute. Adopting its recommendations would mean a shift in philosophy from #USS and rate increases low enough to negotiate on. 2/
Both @UCU and @USSemployers backed the JEP report, the latter with the strikes still fresh in the mind and eager to put the dispute to bed. The issue, as was always likely to be the case, was with #USS itself. 3/
