At the lunch break in today’s Harvey Weinstein trial, the judge is deciding whether to allow prosecutors to call Rosie Perez to the stand. They say Perez can corroborate parts of Annabella Sciorra’s testimony from yesterday that Weinstein raped Sciorra. Decision on Rosie pending.
Prosecutors also called a private eye who said in 8/17 Weinstein sent him an email w/a “red flag list” of people he wanted investigated. The PI said Weinstein was worried people on the list were talking about him to reporters writing negative stories about his sex life.
Annabella Sciorra was on the red flag list w/several others whose names were redacted. The PI, Sam Anson, never undertook an investigation in the end.

Few days ago I asked dozens of lawyers w/incarcerated clients to ask about conditions in NY jail/prisons. Starting to get some responses.
From Greene Correctional:
“They put up posters about washing hands & keeping things clean & wiping things down.” Germicidal wipes passed out.
More from the same Greene inmate:
“As far as people coming in and giving us advice, there hasn’t been any of that.”
“We know we can’t depend on them to make sure we’re all right. We watch the news and get information. We keep ourselves clean anyway.”
From an inmate at Walkill:
Staff sent out memo about hand washing, cover mouth, but no wipes/sanitizer. Visitors being forced to fill out questionnaire about travel, etc, but so far no one denied.

Federal officials announce "Project Python," the US govt's most comprehensive effort to date against the Jalisco New Generation Cartel, one of Mexico's most powerful drug gangs. The linked investigations by DEA led to 300 indictments and 500 arrests since Sept 2019, officials say
DEA boasts big numbers in this 370-investigation operation: 20,000 kilos of drugs seized, including 15K in meth. $22 million seized. US officials have named El Mencho, the leader of CJNG, a drug kingpin and placed a $10 million bounty on him.
DEA saying this is only "Phase 1" of Project Python, noting that over 100 search warrants were executed today alone and more intelligence on CJNG will be coming in.

Manhattan DA releases sentencing memo in the Harvey Weinstein case detailing history of uncharged bad acts going back 40 yrs including several rapes.
"Starting in the 1970s," it says, "he has trapped women into his exclusive control & assaulted or attempted to assault them."
Beyond alleging uncharged sex crimes, the memo says that multiple people told the DA's office that Weinstein "bragged about his ability to get people killed."
The DA's case at trial was narrowly built around the testimony of 6 women. But the memo, which encompasses acts of violence, harassment and abuse, suggests the expansiveness of the prosecutors' full investigation.

Yesterday at Columbia University's 'She Opened the Door' attendees were riveted by the story of Harvey Weinstein's trial.

Jodi Kantor who writes for the NYT talked about "consent."
She talked about
one of the women having sex with Weinstein "consensually" after the initial forced act.

She spoke about how journalists have received threats from Weinstein. She said they have a team to protect them.

When an attendee stood up and asked if journalists are
"threatened" - then how does a woman who is harassed by a powerful predator protect herself? At this moment the questions abruptly ended.

However, that is a question for all of us here: how does a normal person protect themselves against an abusive and powerful individual?

Harvey Weinstein allegedly used an erectile dysfunction injection to help him rape.

FROM THE TRIAL:

“He demanded that she take off her clothes. She refused. He became louder and more aggressive. He grabbed her and began to physically undress her,” Hast said.
When the woman relented and disrobed, Weinstein “ordered her onto the bed and disappeared for a moment into the bathroom,” Hast said, then “came back out, got on top of her and raped her.”

The woman, who Hast said was “distraught, disgusted and horrified,” ran
into the bathroom and “saw a needle in the garbage can.”

“She looked at the label of the wrapper and later Googled it,” learning that it was for an erectile dysfunction drug, Hast said.

Knowing that the #Weinstein trial is starting, today is a good day to think about ways you can support people affected by sexual violence and harassment in their lives. Here is a thread of five ways you can be an ally to survivors. #MeToo
1. We are listening. When you talk/post/tweet about the trial & shame or blame the survivors, we are listening. We are judging if we can trust you with our own stories. If people in your life say victim-blaming statements check in with them and share why these are damaging.
Be prepared. Throughout this trial and afterwards, people you care about might disclose that they are survivors of sexual violence be it harassment, assault or rape. Listen, believe, remind them it’s not their fault — that they have the right to be safe and they are not alone.

I’m covering opening arguments of the first federal trial over claims that Monsanto’s Roundup causes cancer this morning. The line to get into the courtroom was hella long.
Judge Chhabria is in the courtroom and asked attorneys if there are any issues he needs to address before bringing in the jury. Both sides are asking the judge to reconsider some pre-trial rulings, mostly re what's admissible during the 1st causation phase of this 2-phase trial.
Judge Chhabria isn't budging on any of his pre-trial rulings. He's calling in the jury in a few minutes.
