Ministry of Home Affairs inform Justice AM Khanwilkar led SC bench that the 8 foreign #Tablighi nationals from Bihar who were discharged of all cases now face a revision petition filed against the trial court order. ASG KM Nataraj states that they can travel back on undertaking
Sr Adv Chander Uday Singh: This delay is causing anguish to the foreigners and that the process should be expedited so that they can travel back to their home countries
SC: We will pass orders when a representation seeking request for travel back is received and that it shall be decided preferably within 4 days, and not later than one week.
Asks ASG: Who is the nodal officer who will deal with such representations?
Adv for State of Bihar: Patna HC has passed an order on October 14 to consolidate the matters and to transfer the trials to Patna.
SC: We will wait for the orders
ASG Nataraj: Joy Thirkey, Deputy Commissioner of Police, Delhi, will be the nodal officer for dealing with the representations of foreign nationals in and look at the cases seeking travel back to their native countries.
The eight persons, who have been discharged by the trial court, are at liberty to file application before the trial court and to give undertaking for travel back to their home country. Further ubject to the conditions of court, the Union to allow such travel
SC : the foreign members may submit representations to the nodal officer suggested by the ASG for travel back to native country, which shall be decided preferably in 4 days, not later than one week.
Senior Counsel Vikas Singh for the petitioner tells the Court that the State of Punjab has filed an affidavit while States of Haryana and UP have not.
Singh argues that something needs to be done.

Singh: The prayer in my petition is that a one man commission of Justice (retd) Madan Lokur can be appointed because he has dealt with many environment issues... Because state agencies and EPCA etc are not empowered and don't have any teeth to take action.
