The case was already heard by SCOTUS in November. The decision is expected sometime this spring or summer.
The other option is for Dems to #MootTheSuit via simple legislation to either:
1. β¬οΈ the mandate penalty back to $1 or more 2. Formally state that the mandate can be βοΈ

HOWEVER, all 3 of these present additional headaches:
--#2 or #3 would require 60 votes in the Senate if the filibuster is kept
--#1 could be done with only 50 votes via reconciliation, but I've been told that it might have to be more than $1 to "count" as a budget item.
The original federal mandate penalty was $695/person or 2.5% of household income (whichever was larger). The 2017 GOP tax bill changed it to $0 or 0.0%.
It sounds like to #MootTheSuit, Dems would have to reset it to perhaps $100 / 1% of income to pass the reconciliation test.
Frankly, if they're gonna do THAT, they might as well just reset it back to $695 / 2.5% of income.
For one thing, doing so would reduce unsubsidized premiums by around 6-8% on average, saving unsubsidized enrollees ~$580/year. nytimes.com/2018/12/27/opiβ¦

Nearly every state is offering a *new* #COVID19 Enrollment Period this spring! Some have already started; most begin on February 15th. Here's a summary of the start/end dates as well as who's eligible to enroll via the new enrollment period: 2/

Remember, even if you fall outside the parameters above, ANY documented U.S. resident is ALWAYS eligible for a 60-day Special Enrollment Period if they have a qualifying life experience like losing coverage, getting married/divorced, moving, giving birth, etc. #GetCovered!
Also, Native Americans & Alaska Natives can enroll in #ACA exchange plans year-round.
FINALLY, you can enroll in MEDICAID or CHIP year round in any state, and you can enroll in the Essential Plan, MinnesotaCare or Connector Care year round in NY, MN & MA respectively.
Also, using the *literal* geographic center of the country as the metaphor supports those stupid election maps showing a sea of red with dots of blue, even though more people for Dems than Republicans. The big Dem cities are mostly on the coasts. Guess whatβs in the βmiddleβ?
